Chapter 1 General Provisions Article 1 In order to promote the development of geographical indication products in our province, ensure the quality and characteristics of geographical indication products, and safeguard the legitimate rights and interests of operators and consumers, in accordance with the "People's Republic of China and the These measures are formulated based on laws and regulations such as the Domestic Product Quality Law and the actual conditions of the province. Article 2 The term "geographical indication products" as mentioned in these Measures refers to products produced in a specific region, whose quality, reputation or other characteristics essentially depend on the natural and human factors of the place of origin, and which are named with geographical names after review and approval. Geographical indication products include:
(1) Planting and breeding products from the region;
(2) All or part of the raw materials come from the region and are produced in the region according to specific processes and processed products. Article 3 Units and individuals engaged in the production, operation, supervision and management of geographical indication products and other related activities within the administrative region of this province shall abide by these Measures. Article 4 The protection of geographical indication products follows the principles of openness, justice, fairness, voluntariness and good faith. Article 5 The people's governments at or above the county level shall uniformly lead the protection of geographical indication products within their respective administrative regions, coordinate and urge relevant departments to perform their duties in protecting geographical indication products, and promote the development of geographical indication product industry associations and professional cooperative economic organizations.
The product quality supervision and other relevant administrative departments of the people's governments at or above the county level shall work together to protect geographical indication products in accordance with their respective responsibilities. Chapter 2 Working Organizations and Responsibilities Article 6 The provincial people’s government shall establish a geographical indication product protection committee, and the municipal and county (city, district) people’s governments shall establish a geographical indication product protection committee (hereinafter collectively referred to as the protection agency) based on work needs to be specifically responsible for this administrative Protection of geographical indication products in the region. The office of the protection agency is located in the product quality supervision administrative department at the same level. Article 7 The protection agency is composed of relevant administrative (industry) authorities, industry associations, technical experts and representatives of producers and operators of geographical indication products. Article 8 The provincial protection agency shall perform the following duties:
(1) Responsible for the protection, supervision and management of geographical indication products in the province;
(2) Responsible for the preliminary review of applications for geographical indication products and application work;
(3) Responsible for the preliminary review and application work of applications for the use of special marks for geographical indication products;
(4) Guide applicants for geographical indication products in formulating relevant regulations for the product Standards or management regulations;
(5) Other responsibilities prescribed by laws and regulations. Article 9 Municipal and county (city, district) protection agencies are responsible for the protection and daily supervision and management of geographical indication products within their respective administrative regions, and perform other duties stipulated in laws and regulations. Chapter 3 Application and Review Article 10 Products applying for geographical indication protection shall meet the requirements of safety, health and environmental protection. Products that may cause harm to human health, the environment, ecology, resources, etc. will not be accepted and protected. Article 11 Applications for geographical indication product protection shall be submitted by the application agency for geographical indication product protection designated by the local people's government or the recognized associations, enterprises and professional cooperative economic organizations (hereinafter referred to as the applicant) after soliciting the opinions of relevant departments. Article 12 For geographical indication products to be protected, corresponding national standards, local standards or management regulations shall be formulated based on the product category, scope, popularity, production and sales of the product and other factors.
Local standards for geographical indication products are formulated and published by the provincial standardization administrative department; management specifications are formulated by the applicant. Article 13 If the product applied for geographical indication protection is within the scope of a county, the county-level people's government shall propose a proposal for the scope of origin; if it crosses the scope of a county, the people's government of a districted city shall propose a proposal for the scope of origin; if it crosses the scope of a district or city, , the Provincial People's Government will propose the scope of origin.
Article 14 Applicants shall submit the following materials when applying for geographical indication product protection:
(1) The local people’s government’s suggestions on delineating the scope of origin of geographical indication products;
(2) ) Documents for the local people's government to establish an application agency for geographical indication products or to identify associations, enterprises, and professional cooperative economic organizations as applicants;
(3) National (local) standards or management of the geographical indication products to be applied for Specifications;
(4) Certification materials for geographical indication products, including:
1. Application for protection of geographical indication products;
2. Name of the product, Description of the category, origin range and geographical characteristics;
3. Description of the physical, chemical, sensory and other quality characteristics of the product and its relationship with the natural and human factors of the origin;
4. Product production technical specifications (including product processing technology, safety and health requirements, technical requirements for processing equipment, etc.);
5. Product popularity, product production, sales, and description of historical origins. Article 15 After receiving the application materials from the applicant, the provincial protection agency shall conduct a preliminary review to determine whether the product meets the requirements for geographical indication products and whether the application materials are true and complete.
For those who pass the preliminary review, the provincial protection agency shall issue preliminary review opinions and submit relevant documents to the national product quality supervision administrative department; if the application materials are incomplete, the applicant shall be notified to make corrections; if the applicant fails the preliminary review, the applicant shall be informed in writing Notify the applicant and state the reasons.
