Q: Hello, my friend is a staff member of the Trademark Review and Adjudication Board. Is it illegal for my friend to engage in trademark agency business?

A: The Scout Law Online Consultation will answer your question.

Trademark reexamination refers to an activity in which an applicant refuses to accept the ruling of the Trademark Office and applies to the Trademark Review and Adjudication Board according to law, and the Trademark Review and Adjudication Board will hear the case according to law. It mainly includes: rejection of trademark review, trademark objection review, rejection of trademark transfer review, rejection of trademark renewal review, cancellation of registered trademark review, and cancellation of improperly registered trademark review.

It should be noted that the applicant shall, within 15 days from the date of receiving the notice of rejection, ruling or revocation, file a request for reexamination with the Trademark Review and Adjudication Board. If there are special reasons, you can apply for an extension before the expiration, and the extension time is 30 days, but you need to pay the extension request fee. If a party refuses to accept the ruling of the Trademark Review and Adjudication Board, it shall bring a lawsuit to the people's court within 30 days from the date of receiving the notice.
