There is no specific stipulation on the examination period of trademark transfer in China, but according to the current examination progress of trademark transfer application by China Trademark Office, trademark transfer needs to go through formalities at the Trademark Office, and its process includes: application, acceptance, examination, announcement and issuance of transfer certificate. Trademark notarization is generally completed within 3-5 working days after the trademark holder obtains the Trademark Declaration Notary Certificate. The Trademark Office issued an acceptance letter in about 1-2 months and began to review. The Trademark Office will issue an announcement about 5-8 months after accepting the application, and issue a certificate of approval and transfer of the registered trademark to both parties. You can get the certificate of approval and transfer of registered trademarks within three to four months from the date of application. So under normal circumstances, it takes about six months to a year to transfer a trademark.
Legal basis: Article 42 of the Trademark Law of People's Republic of China (PRC) assigns a registered trademark, the assignor and the assignee shall sign an assignment agreement and file an application with the Trademark Office. The transferee shall guarantee the quality of the goods using the registered trademark.
Where a registered trademark is transferred, the trademark registrant shall transfer the similar trademark registered on the same commodity or the same or similar trademark registered on similar commodities together.
The Trademark Office shall not approve the assignment that is likely to cause confusion or have other adverse effects, and shall notify the applicant in writing and explain the reasons.
After the transfer of a registered trademark is approved, it shall be announced. The transferee shall enjoy the exclusive right to use the trademark from the date of announcement.
