Director Liu Junchen and Director of the Copyright Management Department of the National Copyright Administration Yu Cike introduced the development status of China’s intellectual property rights in 2016 and answered reporters’ questions.
Since last year, the industrial and commercial departments have played their functional roles, done some work, and achieved some results. There are still several more critical links in this work.
1. Increase penalties; some entrepreneurs, including the media, suggest that we should crack down on infringement and counterfeiting in the same way we crack down on drunk driving. The industrial and commercial departments agree with this view, but some penalties are not strong enough now. Last year, the State Administration for Industry and Commerce paid great attention to the assistance of administrative agencies and judicial agencies. If someone is suspected of constituting a crime, he must be transferred and his criminal responsibility shall be investigated. Last year, the State Administration for Industry and Commerce transferred 293 suspected cases of infringement and counterfeiting to the judicial organs, involving a total amount of 160 million yuan, a significant increase over previous years.
2. Credit supervision and big data supervision; now the State Administration for Industry and Commerce and local industrial and commercial departments are building a national enterprise credit information management system, called a national network. my country's more than 80 million market entities, infringement and counterfeiting All illegal records and punishment records must be recorded under this online name, and there are dozens of departments connected to the network. Through this kind of credit supervision and big data supervision, the cost of illegal acts of infringement and counterfeiting will be increased and the occurrence of such illegal acts will be curbed.
3. Highlight key areas. Nowadays, in rural markets, markets at the junction of urban and rural areas, and online markets, the situation of infringement and counterfeiting is also relatively serious, which has always been the focus of management. Last year, the State Administration for Industry and Commerce built several platforms. For example, the Internet market also established a network supervision platform, a 12315 complaint platform, a platform for consumer rights protection, and a platform for the supervision of illegal advertising. Through the joint efforts of all parties, we will curb the occurrence of infringement and counterfeiting online, in rural markets and in the entire market.
Therefore, the effect last year was quite obvious. Last year, the national industrial and commercial system investigated and handled nearly 50,000 cases of infringement and counterfeiting, and settled 45,000 cases, with the amount involved close to 560 million yuan. However, this is a long-term task. Not long ago, the State Administration for Industry and Commerce held a national symposium on trademark supervision in Shijiazhuang, making comprehensive arrangements for the next step in combating infringement and counterfeiting, and further increasing the intensity of the crackdown. This is a two-pronged approach. One is to focus on review and trial to facilitate registration. The second is to strengthen supervision during and after the process, severely crack down on infringement and counterfeiting, and protect trademark intellectual property rights.
