How is the service life of a trademark stipulated?
Article 39 of Chapter IV of the Trademark Law of People's Republic of China (PRC) stipulates that the period of validity of a registered trademark is 10 years, counting from the date of approval of registration. Article 40 stipulates that if a registered trademark needs to be used continuously after the expiration of its term of validity, if the trademark registrant fails to go through the renewal procedures within 12 months before the expiration, it may be granted a six-month renewal. The validity period of each renewal registration is 10 years, counting from the second day after the last expiration of the trademark. If the renewal formalities are not completed at the expiration of the period, the registered trademark shall be cancelled.
