Identification conditions of small and medium-sized scientific and technological enterprises in Zhejiang Province
To apply for the accreditation of provincial-level technology-based SMEs, the following conditions must be met:

(1) An economic entity that has been registered and established in this province for more than one year, with clear property rights, independent accounting, independent operation and self-financing.

(2) having independent intellectual property rights, know-how or advanced knowledge, including patents (applications or authorizations), standards, trademarks, recognized scientific and technological achievements and other know-how, and having products or services based on independent intellectual property rights, know-how or advanced knowledge.

(3) the enterprise has a strong sense of innovation, and the proportion of scientific and technical personnel engaged in R&D and related technical activities in the enterprise to the total number of employees in the enterprise in that year is not less than 1% in principle.

(4) The enterprise has a certain investment in scientific and technological innovation and the ability to continuously carry out scientific and technological innovation activities.

(5) The scale of the enterprise meets the requirements of the Standard Provisions for the Classification of Small and Medium-sized Enterprises (No.3 [211] of the Ministry of Industry and Information Technology) jointly issued by the Ministry of Industry and Information Technology, the National Bureau of Statistics, the Development and Reform Commission and the Ministry of Finance, and the scope of the enterprise includes scientific and technological enterprises such as agriculture, industry and service industry.

(1) Agriculture, forestry, animal husbandry and fishery. Small and medium-sized enterprises with operating income below 2 million yuan. Among them, medium-sized enterprises with an operating income of 5 million yuan or more, small enterprises with an operating income of 5, yuan or more, and micro enterprises with an operating income of less than 5, yuan.

(2) industry. Small and medium-sized enterprises are those with less than 1, employees or operating income of less than 4 million yuan. Among them, medium-sized enterprises with 3 employees and above and operating income of 2 million yuan and above; Small enterprises with 2 employees or more and an operating income of 3 million yuan or more; Micro-enterprises are those with less than 2 employees or operating income of less than 3 million yuan.

(3) Software and information technology services. Small and medium-sized enterprises with less than 3 employees or operating income of less than 1 million yuan. Among them, medium-sized enterprises with 1 employees or more and operating income of 1 million yuan or more; Small enterprises with 1 employees or more and an operating income of 5, yuan or more; Micro-enterprises are those with less than 1 employees or operating income of less than 5, yuan.

Article 23 of the Company Law of the People's Republic of China

To establish a limited liability company, the following conditions shall be met:

(1) Shareholders meet the quorum;

(2) having the capital contribution subscribed by all shareholders in accordance with the Articles of Association;

(3) Shareholders * * * agree to formulate the Articles of Association;

(4) Having a company name and establishing an organization meeting the requirements of a limited liability company;

(5) having a company domicile.

Article 11 of the Administrative Measures for the Recognition of High-tech Enterprises must meet the following conditions at the same time:

(1) The enterprise must be registered for more than one year when applying for recognition;

(2) the enterprise obtains the ownership of the intellectual property rights that play a core supporting role in technology for its main products (services) through independent research and development, transferee, donation and merger;

(3) The technologies that play a core supporting role in the main products (services) of enterprises fall within the scope stipulated in the High-tech Fields Supported by the State;

(4) The proportion of scientific and technical personnel engaged in R&D and related technological innovation activities in the enterprise shall not be less than 1% of the total number of employees of the enterprise in that year;

(5) The proportion of the total R&D expenditure of the enterprise in the last three fiscal years (if the actual operating period is less than three years, the same below) to the total sales revenue in the same period meets the following requirements:

1. The proportion of enterprises with sales revenue less than 5 million yuan (inclusive) in the last year is not less than 5%;

2. The proportion of enterprises with sales income of 5 million yuan to 2 million yuan (inclusive) in the latest year shall not be less than 4%;

3. The proportion of enterprises with sales revenue of more than 2 million yuan in the last year is not less than 3%.

Among them, the total R&D expenses incurred by enterprises in China account for no less than 6% of the total R&D expenses;

(6) The income from high-tech products (services) in the recent year accounts for no less than 6% of the total income of the enterprise in the same period;

(7) the evaluation of enterprise innovation ability should meet the corresponding requirements;

(8) No major safety, major quality accidents or serious environmental violations occurred within one year before the enterprise applied for confirmation.
