Chapter 1 General Provisions Article 1 is to regulate green food production and operation activities, maintain the reputation of green food, ensure green food safety, protect the legitimate rights and interests of producers, operators and consumers, and prevent public health This regulation is formulated in accordance with relevant national laws and regulations and in light of the actual situation of this province to prevent risks and promote the healthy and orderly development of the green food industry. Article 2 All units and individuals engaged in green food production, operation and management activities within the jurisdiction of this province shall abide by these regulations. Article 3 The term “green food” as mentioned in these Regulations refers to safe, high-quality edible agricultural products and related products produced in a good ecological environment, produced in accordance with green food standards, subject to full-process quality control, and obtained the right to use the green food label.
The green food mark is registered as a certification trademark in accordance with the law and is protected by law. Article 4 People's governments at all levels shall strengthen planning, organization, coordination, guidance and services for the development of the green food industry in accordance with the principles of adapting measures to local conditions, making reasonable arrangements, respecting the will of the masses, and operating independently. Article 5 The agricultural and rural administrative department of the Provincial People’s Government is responsible for the supervision and management of green food in the province and organizes the implementation of these regulations.
The municipal (prefecture) and county (city) agricultural and rural administrative departments are responsible for the supervision and management of green food within their respective jurisdictions.
Market supervision and management, ecological environment, health and other departments at all levels are responsible for the supervision and management of green food within the scope of their respective responsibilities. Article 6 People's governments at all levels shall commend and reward units and individuals that have made outstanding achievements in the production, operation and management of green food. Chapter 2 Application and Use of Marks Article 7 Units and individuals that produce and operate green food shall obtain the right to use green food marks in accordance with the law. Article 8: The organization entrusted by the owner of the green food label is responsible for the inspection and preliminary review of application materials of units and individuals applying for the use of green food labels within the province.
The owner of the green food mark as mentioned in these regulations refers to the national green food management agency (hereinafter referred to as the owner).
The agency entrusted by the owner of the green food mark as mentioned in these regulations refers to the provincial green food management agency (hereinafter referred to as the entrusted agency). Article 9 Products applying for the right to use green food labels must meet the following standards or conditions stipulated by relevant national departments:
(1) The environment of the place where the product or product raw materials are produced complies with the environmental quality standards of the place where green food is produced;

(2) The use of pesticides, fertilizers, feeds, veterinary drugs and other inputs conforms to the guidelines for the use of green food inputs;
(3) Product quality conforms to the green food product quality standards;
(4) Packaging, storage and transportation comply with green food packaging, storage and transportation standards. Article 10 Green food franchise units and individuals applying for the right to use green food logos must meet the following conditions:
(1) Have a food production and operation license and a public place hygiene license;

(2) The number of green foods sold shall not be less than 60% of the total amount, and all green food counters must sell green foods;
(3) Employees must be trained in basic knowledge of green foods and possess the Green food label identification ability.
Article 11 Procedures for applying for the right to use the green food label:
(1) The applicant applies to the entrusted agency;
(2) The entrusted agency assigns more than two green food labels Full-time food label management personnel shall conduct on-site inspections in accordance with regulations;
(3) If the inspection is qualified, the environmental monitoring agency designated by the entrusted agency will conduct environmental monitoring and evaluation of the applicant's place of production and business premises;
(4) The entrusted agency will report the application materials to the owner after passing the preliminary review based on the inspection situation and environmental monitoring and evaluation results;
(5) After review by the owner, notify The nationally designated green food monitoring agency shall randomly inspect the declared products or notify the entrusted agency to select and declare product samples on their behalf and send them to the nationally designated green food quality inspection agency for testing;
(6) The owner’s inspection of the products and business premises After passing the final review, a green food mark use license contract will be signed with the applicant, and the applicant will receive a green food mark use certificate. Article 12 The green food label use certificate is valid for three years. When the certificate expires, the user of the mark shall apply for renewal in accordance with national regulations. If the user of the mark fails to apply for renewal within the time limit, or if the application for renewal is not approved, he shall not continue to use the green food mark. Article 13 Without the consent of the owner, the user of the green food mark shall not engage in the following acts:
(1) Change the green food mark on his own initiative;
(2) Change the green food mark on his own initiative The name, address, product scope or other matters of the user of the green food mark;
(3) Allow others to use the green food mark or expand the scope of use of the green food mark. Article 14 Anyone who commits any of the following acts shall infringe upon the right to use the green food mark:
(1) Using the same or similar mark as the green food mark, which is sufficient to cause misunderstanding;
(2) Selling counterfeit products with green food logo;
(3) Forging green food logo;
(4) Infringing the right to use green food logo Providing convenient conditions for warehousing, transportation, mailing, concealment, etc.;
(5) Using the green food logo for false advertising;
(6) Using the green food logo causing other infringements.
