Article 16 An operator who commits one of the acts listed in Items (1) to (6) of Article 5 of these Measures and cannot prove that he has not deceived or misled consumers is a fraudulent act. An operator who commits one of the acts in Items (7) to (10) of Article 6 and Article 13 of these Measures is a fraud.

Article 5 A business operator shall not commit any of the following acts when providing commodities or services:

Article 55 Where a business operator commits fraud in providing goods or services, it shall increase the compensation for the losses suffered by the consumers according to their requirements. The increased amount of compensation is three times the price of goods purchased by consumers or the cost of receiving services. If the amount of compensation is less than that of 500 yuan, it shall be 500 yuan. Where there are other provisions in the law, those provisions shall prevail.
