The Decision of Beijing Municipal People's Government on Amending Some Provisions of the Interim Provisions on the Safety Management of Fireworks and Firecrackers in Beijing is hereby promulgated, and shall come into force as of January 1, 1998. The Interim Provisions of Beijing Municipality on the Safety Management of Fireworks and Firecrackers shall be revised according to this decision and compiled and re-promulgated.
Decision of Beijing Municipal People's Government on Amending Some Provisions of the Interim Provisions on the Safety Management of Fireworks and Firecrackers in Beijing
The Municipal People's Government has decided to amend some provisions of the Interim Provisions on the Safety Management of Fireworks and Firecrackers in Beijing as follows:
1. The name of the regulation is changed to "Provisions on the Safety Management of Fireworks and Firecrackers in Non-Forbidden Areas in Beijing".
2. Article 2 is amended as: "All the production, storage, transportation, sale and discharge of fireworks and firecrackers, fireworks and civilian flares (hereinafter referred to as fireworks and firecrackers) in the non-forbidden areas of this Municipality shall be governed by these Provisions."
3. Article 4 is amended as: "The factories, warehouses and other buildings of fireworks production and storage units must meet the requirements of relevant laws and regulations such as Safety Code for Fireworks Factory Design and Fire Protection Code for Building Design, and set up corresponding safety facilities such as ventilation, cooling, moistureproof, fire prevention, explosion prevention, lightning protection and antistatic. Those who do not meet the requirements are not allowed to engage in the production and storage of fireworks and firecrackers. "
4. Article 5 is amended as: "To establish a fireworks production unit, an application must be submitted to the local public security bureau and county bureau with the approval document of the superior competent department. After the approval of the Municipal Public Security Bureau, the local public security bureau and county bureau will issue a Safety Production License for Explosives, and the certificate will apply to the local administrative department for industry and commerce for a business license."
5. Article 12 is amended as: "During the sales period of New Year's Day, Spring Festival and other festivals, commercial retail units that temporarily sell fireworks and firecrackers must strengthen the safety management of the temporary warehouses they set up, and must leave fire-proof spaces and fire exits around the warehouses, and be equipped with sufficient fire-fighting equipment."
6. Article 13 is amended as: "When transporting fireworks and firecrackers in the non-forbidden area of this Municipality, they shall be transported by special vehicle with the bill of lading of the Municipal Ceramics Miscellaneous Products Company, covered with tarpaulin and bound tightly, and escorted by special personnel.
"Fireworks and firecrackers brought into this city for sale can only be transported after the Municipal Ceramic Miscellaneous Products Company holds the order contract and the Product Inspection Certificate and applies for the Explosive Transport Certificate from the Municipal Public Security Bureau.
"Fireworks and firecrackers shipped out of this city can only be transported after the purchasing unit holds the order contract and the Product Inspection Certificate and applies for the Explosive Transport Certificate from the county and municipal public security bureau where the goods are received.
"Fireworks and firecrackers exported by foreign trade shall be transported with the Transport Certificate for Explosives issued by the county or municipal public security bureau where the exit port is located. Fireworks and firecrackers produced by foreign trade manufacturers outside Beijing must be packed in Beijing in a centralized way. With the contract of Beijing Native Products Import and Export Corporation and the Product Inspection Certificate, they can be transported only after applying for the Explosive Transport Certificate from the public security bureau in the centralized place. "
7. Paragraph 2 is added to Article 14: "Fireworks and firecrackers are not allowed to be sold in the forbidden area. If fireworks and firecrackers need to cross the forbidden area, they must apply to the Municipal Public Security Bureau for approval in advance."
8. Article 16 is amended as: "The purchase and wholesale business of fireworks and firecrackers in this Municipality shall be managed by the Municipal Ceramic Miscellaneous Products Company, and no other unit or individual may engage in the purchase and wholesale business; Units and individuals that are allowed to sell are not allowed to purchase from other channels. All products purchased from other places shall be printed with the words' distribution by Beijing Ceramic Miscellaneous Products Company' on the trademark and reported to the Municipal Public Security Bureau for the record. It is not allowed to purchase or sell dangerous varieties. "
9. Article 17 is amended as: "During New Year's Day, Spring Festival and other festivals, sales outlets shall be set up by district and county supply and marketing cooperatives and their grass-roots supply and marketing cooperatives in non-forbidden areas, but they can only be sold after being approved by the local public security bureau and county bureau and applying for a business license from the administrative department for industry and commerce with the Explosive Sales License."
1. Article 21 is amended as: "Civil signal bombs and fireworks bombs with a caliber of more than 12 cm are only supplied to government agencies and units. The purchasing unit shall go through the purchase formalities at the Beijing Fireworks Factory under the Beijing Arts and Crafts Corporation with the certificate of the unit at or above the county level and the "Explosive Purchase Certificate" and "Explosive Transportation Certificate" of the county and municipal public security bureaus. "
11. Article 22 is amended as: "Except with the approval of the Municipal Public Security Bureau, it is forbidden to set off fireworks and firecrackers in the following places in the non-forbidden area:
" (1) railway stations, bus stops, airports and public traffic intersections;
"(2) roofs, balconies and indoors;
"(3) gymnasiums (fields), public entertainment places and hospitals;
"(4) construction sites, sheds and warehouses with inflammable and explosive materials; Areas within 2 meters of chemical industry zone, gasoline filling station, gas filling station, high-voltage lines, places of interest, parks, rural yards, haystacks, forests and nurseries;
"(5) Other areas where fireworks and firecrackers are prohibited by the municipal government."
In addition, according to this decision, the text and the order of articles, paragraphs and items in the Interim Provisions on the Safety Management of Fireworks and Firecrackers in Beijing are revised and adjusted accordingly.
this decision shall come into force as of January 1, 1998. The Interim Provisions of Beijing Municipality on the Safety Management of Fireworks and Firecrackers shall be revised according to this decision and compiled and re-promulgated.
