Regulations of Lanzhou Municipality on the Supervision and Administration of Grain Circulation
Chapter I General Provisions Article 1 In order to strengthen the supervision and administration of grain circulation, ensure food safety, maintain market order and protect the legitimate rights and interests of operators and consumers, these Regulations are formulated in accordance with the Regulations of the State Council on the Administration of Grain Circulation and other relevant laws and regulations. Article 2 Engaged in business activities such as grain purchase, sale, processing, storage, transportation, import and export (hereinafter referred to as grain business activities) and its supervision and management within the administrative area of this Municipality shall abide by these regulations.

The term "grain" as mentioned in these Regulations refers to wheat, corn, rice, miscellaneous grains and their finished grains. Article 3 The Municipal People's Government shall, under the control of the national macro-policies, be responsible for the balance of total grain and the management of local grain reserves within its administrative area, and improve its ability to control the grain market. Article 4 The municipal administrative department of grain is responsible for the management, industry guidance, supervision and inspection of grain circulation in this Municipality, and supervises and manages the grain circulation in Chengguan District, Qilihe District, Xigu District, Anning District and Honggu District.

Yuzhong County, Gaolan County and Yongdeng County grain administrative departments are responsible for the local grain circulation administration, industry guidance, supervision and inspection, and accept the supervision and guidance of the municipal grain administrative departments.

The administrative departments of industry and commerce administration, product quality supervision, health, price, food and drug supervision shall, within the scope of their respective duties, do a good job in the supervision and management of grain circulation. Article 5 The government encourages market entities of various ownership systems to engage in grain business activities.

Grain business activities shall follow the principles of voluntariness, fairness, honesty and credibility, and shall not harm the legitimate rights and interests of grain producers and consumers or the interests of the public. Article 6 The government encourages the popularization of fortified foods. Nutrition-fortified finished grain processing should meet the national standards and have the corresponding processing capacity. Seventh food industry associations and intermediary organizations should play a role in supervision, coordination and service, strengthen industry self-discipline, standardize industry business practices, and assist the administrative department of food to maintain the order of grain circulation. Chapter II Reserve Emergency Article 8 The Municipal People's Government shall take necessary measures to strengthen the regulation and control of the grain market, and keep the total grain supply and demand in the city basically balanced and the prices basically stable. Article 9 The municipal and county people's governments shall establish local grain reserves.

Local grain reserves are used to regulate grain supply and demand, stabilize the grain market and deal with major natural disasters or other emergencies. Tenth local grain reserve plan issued by the people's government at the same level, the implementation of mandatory management. Local grain reserve storage enterprises shall ensure that the local grain reserves are true in quantity, good in quality and safe in storage.

No unit or individual may use grain reserves without authorization. Eleventh city and county people's governments should establish and improve the grain risk fund system, which is mainly used to support grain reserves and stabilize the grain market.

The municipal and county financial departments shall ensure that the grain risk fund is earmarked according to law, and shall be responsible for the supervision and management of its use. Article 12 The government encourages grain operators to establish a stable relationship between production and marketing with grain producing areas in various forms, encourages the development of contract agriculture, and establishes grain management enterprises with integrated production and marketing. The government gives appropriate preferential treatment when implementing the minimum purchase price, giving priority to transportation. Article 13 The administrative department of grain shall, jointly with the administrative departments of industry and commerce administration, product quality supervision, health, price, food and drug supervision, be responsible for the monitoring and early warning analysis of grain supply and demand. The Municipal People's Government shall timely release information on grain consumption, price and quality, and no unit or individual may fabricate and disseminate false information on food safety. Article 14 The Municipal People's Government shall establish and improve the grain emergency mechanism. When major natural disasters, major epidemics or other unexpected events cause abnormal fluctuations in grain supply and demand, start the grain emergency plan.

Food emergency work should follow the principles of scientific monitoring, prevention first, timely response and effective disposal. Fifteenth after the start of the food emergency plan, the relevant departments shall do a good job in food emergency work within the scope of their respective duties. Grain operators should obey the unified arrangement and dispatch of the government, undertake emergency tasks and ensure the needs of emergency work. Chapter III Operation and Management Article 16 Whoever engages in grain operation shall abide by the following provisions:

(a) accept the supervision and inspection of the administrative departments of food, industry and commerce administration, product quality supervision, health, price, food and drug supervision, truthfully reflect the situation and provide relevant materials;

(two) strictly implement the national standards, and shall not process and sell short-weight, adulterated, shoddy and other foods;

(three) strictly abide by market norms, and shall not steal other people's trademarks, hoard, monopolize or manipulate food prices, or dominate the market;

(4) The grain sold shall have the inspection report issued by the inspection agency that meets the statutory conditions and the relevant sales license certificate. The food, production and processing enterprises listed in the Catalogue of Food Production License shall affix (print) the market access mark and number of food quality and safety;

(five) the implementation of the national grain statistics system, the establishment of business ledger, truthfully submit statistical data and information on schedule;

(six) operators who have obtained the qualification of grain purchase shall accept the qualification examination of the administrative department of grain.
