Legal basis: Upon the expiration of Article 46 of the Trademark Law of People's Republic of China (PRC), if the parties concerned do not apply for reexamination of the Trademark Office's decision to declare a registered trademark invalid or bring a lawsuit to the people's court on the reexamination decision of the Trademark Review and Adjudication Board to maintain or declare a registered trademark invalid, the decision of the Trademark Office or the reexamination decision or ruling of the Trademark Review and Adjudication Board will take effect.
