Article 5 Reporting rewards shall meet the following conditions at the same time: (1) There is a clear target to be reported and specific illegal facts or clues about illegal crimes; (2) The content of the report has not been grasped by market supervision, agriculture, water, public security and other departments in advance; ( 3) If the reported situation is investigated by the market supervision, agriculture, water, public security and other departments, and if it is verified to be true, an administrative penalty decision will be made or the case will be transferred to the judicial authority for criminal judgment in accordance with the law. Article 6 The implementation of reporting rewards shall follow the following principles: (1) Reporting rewards are in principle limited to real-name reports. If an anonymous whistleblower has a request for reporting rewards, he shall promise that it does not fall into the circumstances of Article 7 (1) and (2). And provide information and effective contact information that can identify the reporting identity.

(2) If the same case is reported by two or more whistleblowers with the same clue, the first whistleblower will be rewarded. (3) If two or more people jointly report the same case, the reporting reward will be based on the same case, and the bonus will be distributed by the whistleblower through negotiation. (4) No repeated rewards will be given for the same reported matter by the same whistleblower; no repeated rewards will be given for two or more related reported matters filed by the same whistleblower with the same content. (5) If the illegal facts finally determined are inconsistent with the reported matters, no reward will be given; if the illegal facts finally determined are partially consistent with the reported matters, only the reward amount for the consistent part will be calculated; in addition to the reported matters, other illegal facts are also determined , other illegal facts will not be calculated into the reward amount. Article 7 Those who have any of the following circumstances are not within the scope of rewards under these measures: (1) Staff members of market supervision, agriculture, water, public security and other relevant departments or who are responsible for statutory supervision, discovery, and reporting of illegal acts in accordance with food-related laws and regulations Reports from voluntary personnel; (2) Reports from the counterfeited parties of counterfeit or shoddy products and their authorized agents or interested parties; (3) Defects in labels and instructions that do not affect product quality and safety and will not mislead the public Reporting; (4) Other reward situations that do not comply with laws and regulations. Article 8 Reporting rewards are divided into three reward levels based on the reporting evidence and verification results of illegal facts: Level 1: Provide detailed illegal facts, clues and direct evidence of the party being reported, and the content of the report is completely consistent with the illegal facts. Level 2: Provide illegal facts, clues and partial evidence of the party being reported, and the content of the report is consistent with the illegal facts. Level 3: Provides illegal facts or clues about the party being reported, and the content of the report is basically consistent with the illegal facts. Article 9: After the reported illegal behavior is verified to be true and the case is filed and investigated by the relevant departments, rewards will be given according to the amount of administrative penalties and confiscations. In principle, the reward amount for each case shall not exceed 300,000 yuan. The specific reward standards are as follows: (1) If it is a first-level reporting reward, the reward will be 4% of the fine or confiscation amount or the auction amount of the items involved. If the calculation is less than 2,000 yuan, a reward of 2,000 yuan will be given. If it is a second-level reporting reward, the reward will be 2% of the fine and confiscation amount involved or the auction amount of the items involved in the case. If the calculation is less than 1,000 yuan, a reward of 1,000 yuan will be given. For level three reporting rewards, the reward will be 1% of the fines and confiscations involved or the auction amount of the items involved in the case. If the calculation is less than 200 yuan, a reward of 200 yuan will be given. (2) If the illegal behavior does not involve the amount of fines and confiscations, but the content of the report is true, a reward of 200-2,000 yuan will be given depending on the situation. (3) If an insider in the development, production, operation, or use process reports, the reward amount can be doubled according to the above standards. Article 10 If the reported illegal act is found guilty by the court, a one-time reward will be given according to the following amounts: (1) If a person is fined, a reward of 5% of the fine will be given; (2) If a person is sentenced to a criminal penalty, the prison term shall be less than one year ( (including one year) will be rewarded 5,000 yuan per person. For those with a sentence of more than one year, the reward will be 5,000 yuan per person cumulatively for each year exceeded. If both a prison term and a fine are imposed, the reward shall be the higher after calculation according to paragraphs 1 and 2 of this article. If the reported illegal act is administratively punished and then found guilty by the court, the reward will be higher after calculation according to Articles 9 and 10. The maximum reward amount for each report shall not exceed 300,000 yuan. If the reported illegal act is suspected of being a crime and is transferred to the public security organ for investigation, and criminal compulsory measures are taken against all or part of the persons involved, and if the evidence of the crime is relatively sufficient, the food safety supervision and management department responsible for the transfer may first give the whistleblower 5,000 yuan reward; after the criminal judgment takes effect, the whistleblower will be rewarded according to the standards, and the rewards already given in advance should be deducted from it.

Article 11 If one of the following circumstances is met and the whistleblower has made a particularly significant contribution, the reward amount shall in principle be no less than 300,000 yuan: (1) reporting systemic or regional food safety risks; (2) reporting involving infants and young children Formula milk powder, vaccines included in the national immunization plan and other varieties, which have caused great harm to public health or may cause great harm; (3) Report intentional adulteration, fabrication and sale of counterfeit products, and have caused great social harm or may cause great harm. Causing major social harm; (4) Other reports that have major social impact as determined by market supervision, public security and other departments at or above the provincial level. Article 12 Reporting rewards shall be handled according to the following procedures: (1) Application. If the "Report Record" indicates reward requirements, the administrative law enforcement agency responsible for investigating the report and making the final decision shall, after completing the investigation and handling of the report, provide feedback to the whistleblower within 15 working days for those who meet the reward conditions stipulated in these Measures. Process the results and start the reward process according to the whistleblower's willingness to reward. The case handler shall fill in the "Jiaojiang District Food Safety Violation Report Reward Approval Form", determine the level of merit, explain the basis for the reward, calculate the proposed reward amount, and attach the "Report Record", "Administrative Penalty Decision", and fine and confiscation notes , sent to the person in charge of the case handling agency for review. After the person in charge of the case-handling agency and the person in charge of the office signs the review opinions, they are submitted to the leaders of the case-handling agency and the bureau in charge of finance for approval. (2) Approval. If the case reward amount is less than 10,000 yuan, it will be reviewed and approved by the deputy director in charge of finance; if the case reward amount is more than 10,000 yuan, it will be discussed and decided by the case review committee or the director's office meeting, and the director will review and approve. (3) Notice. After the reporting reward is approved, the administrative law enforcement agency that specifically handles the case should fill out the "Jiaojiang District Food Safety Violation Reporting Reward Notice" within 5 days and serve it to the reporter. If the whistleblower cannot be notified for some reason, the case handler should record the notification. If the whistleblower cannot be notified within 6 months after the reward is submitted for approval, the reward will be cancelled. (4) Distribution. The whistleblower shall receive the reward in person with valid identity certificate within 30 working days from the date of being informed of the reward decision. If someone else is entrusted to collect the money on their behalf, the trustee must also hold the informant’s power of attorney and the valid identity certificates of both the informant and the trustee. If the whistleblower fails to receive the bonus within the time limit without justifiable reasons, the reward will be deemed to have been given up. The financial institution will use the countersigned "Reward Fund Release Form for Reporting Economic Violation Cases" as the original voucher for payment, and directly transfer the reward money to the bank account provided by the whistleblower through bank transfer. Article 13: Market supervision, agriculture, water, public security and other departments should establish and improve reporting and reward files, and do a good job in summary statistics. Article 14 Market supervision, agriculture, water, public security and other departments shall protect the legitimate rights and interests of whistleblowers in accordance with the law and shall not disclose relevant information of whistleblowers. Article 15 If staff of market supervision, agriculture, water, public security and other departments, in the process of implementing reporting rewards, fall into the following circumstances, they will be given administrative sanctions depending on the severity of the case; if a crime is constituted, they will be transferred to the judicial authorities for investigation of criminal liability in accordance with the law: (1) Forgery Or instigating or collaborating with others to forge reporting materials and falsely receive reporting bonuses; (2) Leaking whistleblower-related information without the consent of the whistleblower; (3) Corruption, misappropriation, private distribution, or withholding of reward funds; (4) Others Behaviors that should bear legal responsibility in accordance with the law. Article 16 If a whistleblower deliberately fabricates facts and falsely accuses others, or defrauds others to obtain rewards, he shall bear corresponding responsibilities in accordance with the law; if a crime is constituted, he shall be transferred to the judicial authority for handling.
