The Trademark Office is subordinate to the State Administration for Industry and Commerce, and is in charge of trademark registration and management throughout the country. It is responsible for the registration of trademarks such as commodity trademarks, service trademarks, collective trademarks and certification trademarks, handling trademark objection rulings, alteration, transfer, renewal, replacement and cancellation of registered trademarks, guiding, coordinating and organizing local industrial and commercial administrative authorities to investigate and deal with trademark infringement and counterfeiting cases, and identifying and protecting well-known trademarks according to law. Supervise and manage trademark agencies, study and formulate rules and regulations for trademark registration and management, and specific measures and methods, organize the specific implementation of international treaties and agreements on trademarks in China, and undertake the related work of international exchange and cooperation on trademarks.

the trademark office consists of 16 functional departments, including the general office, the application acceptance office, the first review office, the second review office, the third review office, the fourth review office, the fifth review office, the international registration office, the first objection ruling office, the second objection ruling office, the trademark filing office, the change renewal office, the legal affairs office, the case guidance office, the supervision management office and the computer system management office, with a staff of 245 people. There are 21 staff members, including 144 examiners.

After the founding of New China, China's trademark registration was successively under the charge of the Central Bureau of Private Enterprises and the Central Administration for Industry and Commerce. After the establishment of the State Administration for Industry and Commerce of the People's Republic of China in 1978, a Trademark Office was established. According to the Trademark Law promulgated in 1982, the Trademark Office is in charge of trademark registration and management throughout the country. Local industrial and commercial administrations supervise and manage the use of trademarks, investigate and deal with violations of the exclusive right to use registered trademarks ex officio or at the request of the right holders, and protect the legitimate rights and interests of trademark owners and consumers.
