Article 2 of the Trademark Law stipulates that the Trademark Office of the State Council Administration for Industry and Commerce is in charge of the national trademark registration and management.

The State Council Administration for Industry and Commerce has set up a Trademark Review and Adjudication Board to handle trademark disputes. The work of the Trademark Review and Adjudication Board and the Trademark Office is interrelated and mutually restricted, which constitutes the administrative management system of trademark authorization, confirmation and trademark protection in China.

The functions and powers of the director of the Trademark Review and Adjudication Board:

(1) To preside over the daily work of the Trademark Review and Adjudication Board;

(2) Deciding on the withdrawal of members of the Trademark Review and Adjudication Board;

(3) Examining and issuing trademark review and adjudication.

The director of the Trademark Review and Adjudication Board may entrust a deputy director to act as an agent.
