What are the ways to obtain trademark rights?
countries all over the world generally adopt the following three ways to obtain the original trademark right: (1) registration, that is, the trademark owner obtains the trademark right through registration. Accordingly, only after applying for registration can the trademark user obtain the exclusive right to use the trademark, and even the unused trademark can also apply for registration. (2) the principle of use, that is, to obtain the trademark right through the use of the trademark. Accordingly, as long as the trademark is used for a certain period of time, even if it is not registered, the exclusive right to use the trademark can be obtained. Some countries that adopt the mode of use also apply for trademark registration, but it is based on whether the trademark has actually been used. The registration of a trademark is only an enhancement of the exclusive right to use a trademark, and does not involve the ownership of the right. (3) the principle of mixing. There are two ways here. First, the trademark right can only be obtained by applying for registration, but within a certain period of time after the registration is approved, the first user is given the opportunity to cancel the registered trademark that is the same as or similar to his first use trademark on the grounds of prior use; Second, while confirming the exclusive right to use a trademark, the prior user is allowed to continue to use it within the original scope, but the user is not allowed to license others to use its trademark, and can only use it for himself or transfer it together with the enterprise.
