there are three ways to solve the disputes caused by trademark infringement: 1. the parties negotiate to solve them, and the trademark registrant or interested party brings a lawsuit to the court or requests the relevant administrative department to handle them. In our country, the administrative department for industry and commerce has the right to identify the infringement, and take law enforcement measures to order it to stop, confiscate and destroy the infringing goods and tools specially used to manufacture infringing goods and forge registered trademarks, and may also impose a fine. 2. If the party refuses to accept the administrative decision ordering it to stop the infringement, it may bring a lawsuit according to law; If the infringer neither brings a suit nor performs it within the time limit, the administrative department for industry and commerce may apply to the people's court for compulsory execution. It is simple in procedure to solve the dispute of trademark infringement through administrative organs, and it is also effective from the purpose of stopping the infringement, but it is impossible for the infringed person to get civil compensation through this administrative investigation. 3. In case of infringement, the infringed person can also directly file an infringement lawsuit with the people's court, and litigation is the ultimate solution. Even if the case has been handled by the administrative department for industry and commerce, the party concerned can still bring a lawsuit to the people's court and make various requests for civil relief through judicial channels.

Legal basis

Article 6 of the Trademark Law

If any of the acts listed in Article 57 of this Law infringes on the exclusive right to use a registered trademark and causes a dispute, the parties concerned shall settle it through consultation; Unwilling to negotiate or failing to negotiate, the trademark registrant or interested party may bring a suit in a people's court or request the administrative department for industry and commerce to handle it.
