Registration Subjects Trademark agencies that can be registered with the Trademark Office include service agencies registered by the industrial and commercial administration departments to engage in trademark agency business and law firms engaged in trademark agency business. A trademark agency registered with the industry and commerce should include “trademark agency” or “intellectual property agency” items in its business scope. 2. How to handle the filing: The trademark agency can submit the filing directly or by mail. If submitted directly, the Trademark Office will review the registration form filled in as required and the relevant supporting documents submitted for inspection, and keep copies of the documents submitted for inspection. If applying by mail, the trademark agency shall fill in the filing form as required and submit copies of relevant certification documents stamped or notarized by the registration authority. Registration of change of trademark agency After the registered trademark agency has completed the change registration procedures in accordance with the law, it shall promptly file the change with the Trademark Office. If the trademark agency fails to do so, it shall bear the legal consequences arising therefrom. (1) If the name, address, or person in charge of the trademark agency is changed, the trademark agency change registration form should be filled in and the following documents should be submitted: 1. Change certification document issued by the registration authority, or change certification stamped with the seal of the registration authority A copy of the document, or a notarized copy of the change certification document; 2. A copy of the changed industrial and commercial business license and law firm practice license, with the seal of the trademark agency; 3. Person in charge Copy of valid identification document. (2) If you change other filing matters, you should fill in the trademark agency change filing form and submit the following documents: 1. Merger registration of trademark agencies After the registered trademark agency has completed the merger registration procedures in accordance with the law, it shall promptly complete the merger registration with the Trademark Office. If the trademark agency fails to do so, it shall bear the legal consequences arising therefrom. To handle the merger filing of trademark agencies, the trademark agency merger filing form should be filled in and the following documents should be submitted: (1) The merger registration certification document issued by the registration authority, or a copy of the merger registration certification document stamped with the seal of the registration authority, Or a notarized copy of the merger registration certificate; (2) A copy of the merged industrial and commercial business license or law firm practice license, stamped with the seal of the trademark agency; (3) Power of attorney and business license A copy of the applicant’s valid identity document. If other registration matters other than the name of the trademark agency are changed at the same time, the registration process shall be handled according to the change of trademark agency. 6. Trademark Agency Cancellation Filing/Settlement If a trademark agency cancels, changes its business registration, or stops handling trademark agency business, it shall sign a termination agreement with the client for uncompleted agency matters or sign a transfer agreement with other trademark agencies with the consent of the client. Commission Agreement. After a trademark agency handles cancellation or change registration, it should promptly handle cancellation filing/settlement with the Trademark Office.
To handle cancellation filing/settlement, the trademark agency cancellation filing/settlement form should be filled in and the following documents should be submitted: (1) Documents proving cancellation of registration or change of registration issued by the registration authority, or the above certification documents stamped with the seal of the registration authority or a notarized copy of the above-mentioned supporting documents; (2) For settlement only, a copy of the industrial and commercial business license stamped with the seal of the registration authority or a copy of the law firm's practice license must be attached, or a copy of the law firm's practice license must be attached. A notarized copy of the above-mentioned identity document, stamped with the seal of the trademark agency; (3) A copy of the power of attorney and the valid identity document of the person in charge. When handling settlement, the arrears of fees should be made up in a timely manner. If there is a balance in the advance payment, the Trademark Office will refund it after liquidation; if an account in the name of a trademark agency other than the trademark agency is designated, additional material explanations must be attached. For trademark agencies that have canceled registration/settlement, the Trademark Office will directly deliver the relevant documents to the trademark applicant for its unfinished trademark agency matters or handle them in accordance with the "Notice on the Client to Directly Receive Relevant Documents"; the trademark applicant is a foreign For persons or foreign enterprises, the service of documents shall be handled in accordance with the provisions of Article 5, paragraph 3, of the Implementation Regulations of the Trademark Law. 7. Working time limit The Trademark Office will review the trademark agency’s filing materials within fifteen working days from the date of receipt of the filing materials. Processing fees There are no fees for trademark agency registration. 9. Publication of registration information Registration information of trademark agencies shall be published by the Trademark Office on the China Trademark Network. 10. Supplementary Provisions Before May 1, 2014, the State Administration for Industry and Commerce and the Trademark Office issued normative documents on trademark agency filings. If their provisions conflict with the "Regulations on the Implementation of the Trademark Law" and the contents of this Notice, the "Regulations on the Implementation of the Trademark Law" shall prevail. and comply with the requirements of this Notice.
