1. Joint Trademarks
If the trademark being applied for registration and the registered trademark of the applicant constitute similar trademarks, the examiner will require that the trademark be regarded as a joint trademark of the registered trademark as a condition for the registration of the trademark. Joint trademarks are not allowed to be transferred separately.
2. Certification trademarks
Certification trademarks are used to prove the origin, raw materials, manufacturing methods, quality, accuracy or other characteristics of products. Certification trademarks apply for registration in Part C, and the certifier is the owner of the certification trademarks. The witness shall not deal in the products involved in the certification trademark, otherwise. The certification trademark shall not be registered.
3. defensive trade mark
If a trademark composed of one or more original words has a high reputation, it can be registered as defensive trade mark in Part D.
4. Trademarks with specified colors
A trademark can specify one or more specific colors, and the specified specific colors will be one of the considerations when judging whether the trademark is significant. Trademarks with unlimited colors will be regarded as registered for all colors.
Zambia's trademark registration uses categories similar to the international classification of commodities, and trademarks can only be registered on specific commodities or specific categories of commodities. Zambia is a member of the Paris Convention for the Protection of Industrial Property, the African Regional Industrial Property Organization and the World Intellectual Property Organization.
