Gree is a well-known old brand in China. I believe many people have a deep understanding of it. Every household should have Gree electrical appliances. In this trademark registration incident, Gree sued the State Property Rights Office over the trademark in order to protect its legitimate rights and interests.
The main reason for this incident is that the applicant Xu Changmin believes that Gree, as a well-known enterprise in China, registers an existing similar trademark, which not only lacks the integrity of Gree as a large enterprise, but also disrupts the market economic order and is harmful to the market economy. It caused losses, so Xu Changmin applied to declare the Gree trademark invalid. Gree Electric believes that as a well-known old brand in China, Gree has its own brand charm. Gree mobile phones are just Gree's expansion in the field of mobile phones. The trademark in dispute was also created by Gree, and the trademark also bears the Gree logo. There is no claim that it was registered in bad faith. Therefore, Gree Electric requested to maintain the registration of the disputed trademark.
The State Intellectual Property Office believes that the trademarks of both parties are very similar. In this case, the similar trademarks of both parties may confuse consumers and affect their experience. Moreover, Xu Changmin had indeed registered the trademark before Gree applied for it, so the State Intellectual Property Office ruled that the disputed trademark "Gree Color World" was invalid.
After receiving the news that its trademark was declared invalid, Gree Electric believed that the State Intellectual Property Office’s ruling was unreasonable and infringed on its legitimate rights and interests, so it requested the court to revoke the ruling in accordance with the law. Gree Electric believes that the trademarks disputed by both parties are actually significantly different and will not cause confusion or misunderstanding among consumers. Moreover, as an old brand, Gree also has obvious differences in the meaning of its trademark.
On the basis of Gree’s lawsuit against the State Intellectual Property Office, the court determined that the State Intellectual Property Office’s ruling was erroneous and decided to revoke the State Intellectual Property Office’s ruling that Gree’s trademark was invalid. In this prosecution case, Gree won. In fact, in market competition, it is best if everyone can compete peacefully, make common progress, achieve mutual benefit, and achieve a win-win situation.
