French luxury shoe brand Christian Louboutin’s “red-soled shoes” trademark is finally expected to be recognized in China.
In 2007, French shoe designer Christian
Louboutin successfully applied for a trademark in the UK, specifically referring to "the specific red used on the soles (Pantone color number: 18.1663TP)". In 2010, Christian
Louboutin submitted a trademark territorial extension protection in China, but the China Trademark Office said that the mark "lacked distinctive features" and rejected the application for international registration of the trademark.
After the Trademark Review and Adjudication Board (TRAB) of the State Administration for Industry and Commerce and the Beijing Intellectual Property Court both held that the trademark applied by Christian
Louboutin was a three-dimensional mark and could not be registered as a trademark, the Beijing Municipal Government The High People's Court's second-instance judgment in December 2018 denied the results of the previous trial and held that the applied for trademark was not a three-dimensional mark, but a single color with limited use locations.
