Trademark address change process

The process for changing the trademark address is as follows:

4. When changing the address of the trademark applicant/registrant, there is no need to submit change certification documents. Except for changes of address. If a natural person changes his address across nationalities, he must submit documents proving his right of residence in the country where the address is after the change.

Materials required for trademark address change:

1. The applicant needs to submit relevant identity documents, including a copy of the business license, a copy of the applicant’s ID card, etc.;

2. Change Application Form Applicants need to choose different change application forms based on the specific content of the application. The application must be typed or printed, and a change application form should be filled in for each trademark;

3. If it is required to change the name of the registrant, a change certificate issued by the registration authority must also be submitted;

4. If the applicant entrusts a qualified agency to handle the matter, he/she needs to submit a "Letter of Agency"; if the applicant handles the matter directly in the acceptance hall, a copy of the handler's ID card needs to be submitted;

5. If the application documents submitted by the applicant are in a foreign language, it is recommended to entrust a formal translation agency to translate the documents and sign for confirmation;

6. If the trademark owner is a natural person, transnational If the registered trademark address is changed, the applicant needs to submit proof of change and proof of living at the changed address for more than one year;

In summary, if the name or address of the trademark registrant is changed, the trademark registrant shall change all registered trademarks together; if the changes are not made together, the Trademark Office will notify the trademark registrant to make corrections within a time limit; upon expiration of the time limit, If no correction is made, the application for change shall be deemed to have been abandoned, and the Trademark Office shall notify the applicant in writing.

Article 42

If a registered trademark is transferred, the transferor and the transferee shall sign a transfer agreement and file an application with the Trademark Office at the same time. The transferee shall ensure the quality of the goods using the registered trademark. When transferring a registered trademark, the trademark registrant shall transfer all similar trademarks registered on the same goods, or identical or similar trademarks registered on similar goods. For transfers that are likely to cause confusion or have other adverse effects, the Trademark Office will not approve the transfer and will notify the applicant in writing and explain the reasons. After the transfer of a registered trademark is approved, it will be announced. The assignee shall enjoy the exclusive right to use the trademark from the date of announcement.
