A trademark refers to a visible sign with remarkable characteristics, which is composed of characters, graphics, letters, numbers, three-dimensional signs and colors and the combination of the above elements, and is adopted by producers and operators when they produce, manufacture, process, select or distribute commodities and their packages or services. According to the Trademark Law of People's Republic of China (PRC), trademarks are divided into registered trademarks and unregistered trademarks. In addition to the goods that must use registered trademarks as stipulated in Article 4 of the Regulations for the Implementation of the Trademark Law of People's Republic of China (PRC), business operators can use unregistered trademarks, and goods that use unregistered trademarks can also be sold in the market, but they do not enjoy the exclusive right to use trademarks. Of course, this does not mean that unregistered trademarks are not protected by law. For example, the unique name and decoration protected by People's Republic of China (PRC) Anti-Unfair Competition Law are unregistered trademarks. Trademarks approved for registration by the Trademark Office are registered trademarks, including commodity trademarks, service trademarks, collective trademarks and certification trademarks. Trademark registrants enjoy the exclusive right to use trademarks and are protected by law.
