Chapter I General Provisions
Article 1 (Purpose and Basis)
In order to protect the legitimate rights and interests of domestic people coming to Shanghai, standardize population services and management, improve the level of government services, and promote the coordinated development of the city's economy, society, resources and environment, these measures are formulated in accordance with the Measures for the Administration of Residence Permits in Shanghai.
Article 2 (Applicable Objects)
These Measures shall apply to domestic personnel coming to Shanghai who work and live in this Municipality, hold the "Shanghai Residence Permit" and participate in social insurance for employees in this Municipality.
Article 3 (Residence Permit Points System)
The residence permit points system is to convert the points of residence permit holders (hereinafter referred to as "holders") who legally and stably live and work in this city into corresponding points by setting the points index system. If the score reaches the standard, you can enjoy the corresponding public service treatment.
Article 4 (Division of Responsibilities)
Municipal Human Resources and Social Security Bureau is responsible for the management of residence permit points.
The district (county) government is responsible for the specific organization and implementation of these measures within its administrative area.
Public security, education, health and family planning, science and technology, industry and commerce, taxation, housing security, housing management, civil affairs, economic informatization and other relevant departments shall be responsible for the services and management related to these Measures according to their respective responsibilities.
Chapter II Integral Indicators and Scores
Article 5 (Comprehensive Index System)
The residence permit integral index system consists of basic index, plus index, minus index and one-vote veto index.
Article 6 (Basic Indicators and Scores)
The basic indicators include age, education, professional titles and skill levels, working in this city and years of paying social insurance for employees.
(1) age
The highest score of the age index is 30. The specific integral standards of this project are as follows:
The holder is 56-60 years old, with 5 points; Every time the age decreases by 1 year, the points will increase by 2 points.
(2) Educational background
The highest score of academic qualification index is 1 10, and the holder can get points if he obtains a nationally recognized academic degree at home and abroad according to the regulations of the national education administrative department. The specific integral standards of this project are as follows:
1. The holder has obtained college (higher vocational) education, with a score of 50 points.
2. The holder has obtained a bachelor's degree with a total score of 60 points.
3. The holder obtained a bachelor's degree and a bachelor's degree with a score of 90 points.
4. The holder has obtained a master's degree with the score of 100.
5. The holder has obtained a doctorate with a score of 1 10.
(three) professional and technical titles and skill levels
The highest score of professional and technical titles and skill level indicators 140. If the holder has obtained the professional and technical post qualification certificate, professional and technical vocational qualification certificate and national vocational qualification certificate during his work in this city, and his major and type of work are consistent with the positions he has hired, he can get points. The specific integral standards of this project are as follows:
1. The holder has obtained Grade 5 national vocational qualification in skill category, with a score of 15.
2. The holder has obtained the national vocational qualification level 4 of skill category, with a score of 30 points.
3. The holder has obtained the skills of national vocational qualification level 3, with 60 points.
4. The holder has obtained the second-level and intermediate professional and technical post qualification of the national vocational qualification of skills or the professional and technical post qualification equivalent to the intermediate professional and technical post qualification, and the score is 100.
5. The holder has obtained the first-class qualification of national vocational skills or advanced professional and technical post qualification, with the score of 140.
The holder applies for the points with the qualifications of senior professional and technical posts and the second and first level of national vocational skills qualifications, and the base for paying social insurance premiums for employees for 6 months in recent 1 year shall not be lower than the average social wage of employees in this city in the previous year.
Professional and technical professional qualifications need to be registered in accordance with the relevant provisions of the state, and extra points will be given after registration.
The catalogue of professional and technical vocational qualifications and the catalogue of national vocational qualifications of skills are uniformly announced to the public by the Municipal Human Resources and Social Security Bureau.
(4) Working in this Municipality and paying social insurance for employees.
If the holder works in this city, he/she shall pay the social insurance premium for employees on a monthly basis according to the relevant regulations of the state and this city, and accumulate 3 points for each full 1 year.
If the holder fails to pay the social insurance premium for employees in this Municipality normally, and the unit that pays the social insurance premium for employees is inconsistent with the unit that signed the labor (employment) contract, it will not be used as the basis for this score.
Article 7 (Extra Points and Scores)
The bonus indicators include entrepreneurial talents, innovative and entrepreneurial intermediary service talents, shortage of urgently needed majors, investment in tax payment or promotion of local employment, payment of social insurance premiums for employees, specific public service areas, key areas in outer suburbs, full-time fresh graduates, recognition and awards, and spouse's household registration in this city.
(A) Entrepreneurial talents
Entrepreneurial talents who meet certain conditions will get 120 points.
The specific conditions for the integration of entrepreneurial talents shall be formulated by the Municipal Science and Technology Commission in conjunction with relevant departments and announced to the public.
(B) innovation and entrepreneurship intermediary service personnel
Qualified innovation and entrepreneurship intermediary service talents, score 120.
The specific conditions for the integration of innovative and entrepreneurial intermediary service talents shall be formulated by the Municipal Science and Technology Commission in conjunction with relevant departments and announced to the public.
(C) the urgent need for professionals
If the holder's major belongs to the catalogue of urgently needed majors in this city, and the post is consistent with the major he studied, a total of 30 points will be scored.
The catalogue of urgently needed specialties in this Municipality shall be formulated by the Municipal Human Resources and Social Security Bureau in conjunction with relevant departments and announced to the public.
(four) investment tax or promote local employment.
According to the individual investment share, the enterprise established by the holder in this city has paid an average annual tax of more than 6,543,800 yuan in recent three consecutive years, or the registered personnel in this city have an average annual employment of 654.38+ 00 yuan or 654.38+00 yuan, and the maximum score for each registered personnel in this city is 654.38+02 yuan.
(5) The base for paying social insurance premiums for employees.
The maximum index of social insurance premium paid by the holder in this city is 120. The specific integral standards of this project are as follows:
1. If the base number of social insurance premiums paid by the holder in this city for 36 consecutive months in the last 4 years is equal to or higher than 80% of the average social wage of employees in this city in the previous year and less than 1 times, a total of 25 points will be added.
2. If the holder has paid social insurance premiums for employees in this Municipality for 36 months in the last 4 years, the base is equal to or higher than the average social wage of employees in this Municipality in the previous year 1 times, and if it is less than 2 times, the accumulated score is 50 points.
3. If the base of the social insurance premium paid by the holder in this city for 36 consecutive months in the last 4 years is equal to or higher than 2 times but less than 3 times the average social wage of employees in this city in the previous year, the cumulative score is 100.
4. If the base of 24-month accumulated social insurance premium paid by the holder in this city in the last 3 years is equal to 3 times of the average social wage of employees in this city in the previous year, the accumulated score is 120.
If the holder fails to pay the social insurance premiums of employees in this Municipality normally, and the payment base of employee social insurance cannot reasonably correspond to the payment base of individual income tax, and the payment unit of employee social insurance is inconsistent with the unit that signed the labor (employment) contract, it will not be regarded as the integral basis of this item.
(6) Specific public service areas.
If the holder is employed in a specific public service field in this Municipality, he/she will accumulate 4 points every full year 1 year, and will be included in the total points after 5 years.
(seven) key areas in the outer suburbs
The holder who works and lives in the outer suburbs of this city has a maximum score of 20 points, and 2 points are accumulated every 1 year, which will be included in the total score after 5 years.
(8) Full-time fresh graduates
The holder is a full-time college graduate with a score of 10.
(9) Commendation and reward
The commendation and reward obtained by the holder during his work in this city can be scored, with the highest score of 1 10. The specific integral standards of this project are as follows:
1. The holder was awarded special commendation by the departments, commissions, offices and bureaus directly under the municipal government, with a score of 30 points.
2. The holder won the comprehensive commendation award of the municipal departments, commissions, offices and bureaus, with a score of 60 points.
3. The holder won the government award at or above the provincial level, with a score of 1 10.
The municipal government ministries, commissions, offices, bureaus and other municipal organs shall commend and reward the project catalogue, which shall be implemented in accordance with the catalogue of commendation and awards approved and published by the municipal government.
(10) The spouse is a registered resident of this city.
The holder's spouse is a registered resident of this city, and every marriage 1 year accumulates 4 points, with a maximum score of 40 points.
Article 8 (Deduction Index and Score)
The reduction indicators include providing false materials, administrative detention records and general criminal records.
(1) Providing false materials when applying for points
If the holder provides false information such as identity, education background, employment, professional title qualification, marriage, commendation and reward within 3 years, it will be deducted 150 points each time.
(2) Records of administrative detention
If the holder has a record of administrative detention within 5 years, 50 points will be deducted for each item.
(3) General criminal record
If the holder has a general criminal record within 5 years, each item will be deducted 150 points.
Article 9 (One-vote veto indicator)
If the holder has a record of violating the national and municipal family planning policies or a serious criminal record, he will be disqualified from applying for points.
Chapter III Integral Rules and Standard Scores
Article 10 (Integral Rules for Individual Indicators)
Among the basic indicators and bonus indicators, the integral of the same single indicator is not calculated repeatedly, and the highest score of the single indicator is taken.
Deduction points for individual indicators in the deduction indicators shall be deducted according to the accumulated deduction items.
Article 11 (Rules for Total Score and Integral)
The total score of the holder is equal to the sum of the scores of the basic index and the plus index minus the cumulative deduction score of the minus index, and the minimum total score is 0. In the basic indicators, choose one of the two indicators "education", "professional and technical title" and "skill level" to score. In the bonus items, choose one of the two indicators of "investment tax payment" and "investment driving local employment" for bonus points.
Article 12 (Total Score Standard Score)
Total score of residence permit 120.
Chapter IV Sub-bidding Process and Management
Article 13 (Application for Points)
If the holder needs to apply for points, he can log in to the Shanghai residence permit points management information system through the Internet to conduct online simulation evaluation. To reach the standard score, apply to the employer, entrust the employer to apply for points to the registered area (county) talent service center.
Article 14 (Application Materials for Points)
The holder and the entrusted employer shall submit the basic materials for the application for points, including:
1. The holder's residence permit within the validity period;
2. Shanghai residence permit points application form;
3. Labor (employment) contract;
4. Promise no materials that violate the family planning policies of the state and this Municipality;
5. Materials promising no criminal record;
6. Business license of the company (certificate of legal person registration certificate, enterprise legal person or private non-enterprise legal person, etc. ) and organization code certificate and magnetic card.
In addition to the above-mentioned basic materials for points application, the holder shall also provide materials corresponding to the points index items of residence permit.
Article 15 (Material Acceptance)
After receiving the application materials for points, the talent service center shall issue a receipt certificate if the materials are complete; If the materials are incomplete, they shall be informed on the spot to fill in the materials.
The holder and the employer shall be responsible for the authenticity of the application materials for points.
Article 16 (Material Audit)
After accepting the application materials for points, the talent service center shall, in accordance with the relevant provisions on the management of personnel files of floating personnel, access the personnel files of the holder and review the relevant materials.
Review the points application materials submitted by the holder, such as academic degree certificate, professional and technical post qualification certificate, professional and technical vocational qualification certificate, technical national vocational qualification certificate, award-winning certificate, marriage certificate, household registration book, capital verification report, tax payment details, employment certificate of household registration personnel in this Municipality, etc. The materials in question can be submitted to the competent department or specialized agency for verification.
Article 17 (Integral Verification)
If the application materials for points are verified, the human resources and social security department shall verify the points according to the residence permit points index system within 20 working days, and inform the points holders.
Article 18 (Overall Inquiry)
The holder can check his points in the community affairs acceptance service center and talent service center through the internet or with his residence permit.
Article 19 (Confirmation and Adjustment of Integral)
In the "residence permit endorsement", the points of the holder will be confirmed.
If the holder's situation changes and the points need to be adjusted, the employer shall be entrusted to submit relevant materials to the talent service center at the place of registration (county).
If the change of the holder's points leads to the reduction of points or sub-items, the human resources and social security department will deduct points and inform the holder.
Article 20 (Invalid Integral)
The holder's residence permit is cancelled and the points automatically become invalid.
Article 21 (Supervision and Review)
The Municipal Human Resources and Social Security Bureau shall supervise and inspect the city's bid for points, and correct the points obtained through illegal materials.
If the holder and the employer have any objection to the residence permit points, they shall be submitted to the human resources and social security department for review.
Relying on Shanghai public credit information service platform, strengthen the supervision of residence permit points application information.
Article 22 (Legal Liability for Providing False Materials)
Individuals who forge, alter or use forged or altered application materials in the process of applying for points shall be punished by the public security department in accordance with the relevant provisions of the Law of People's Republic of China (PRC) on Public Security Administration Punishment; If the circumstances are serious, you may not apply for points within 3 years; If a crime is constituted, criminal responsibility shall be investigated according to law.
If a unit forges, alters or uses forged or altered application materials in the process of applying for points on its behalf, the human resources and social security department shall impose a fine of 30,000 yuan to 50,000 yuan; If the circumstances are serious, you may not apply for points within 3 years. The directly responsible person in charge and other directly responsible personnel shall be punished by the public security department in accordance with the relevant provisions of the People's Republic of China (PRC) Public Security Administration Punishment Law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Chapter V Supplementary Provisions
Article 23 (Dynamic Adjustment)
According to the needs of the city's economic and social development, the Municipal Human Resources and Social Security Bureau, in conjunction with the municipal development and reform, public security, education, health and family planning, science and technology, industry and commerce, taxation, housing security, housing management, economic informationization and other departments, put forward an adjustment plan for the residence permit points management index system and standard scores, which will be announced to the public after being approved by the municipal government.
