How to transfer my trademark? What is the transfer process?

Perhaps you rarely come into contact with private trademarks, because most private trademarks are trademarks that have not been used by companies and are usually rarely used, or they are directly used to promote other people's trademarks through trademark licensing. After the trademark licensing relationship ends, many companies believe that if they do not use their trademarks, they may be revoked by others after a period of time. So how do we transfer our trademark? What is the transfer process?

Ownership trademark registration is to cater to the brand strategy of new products. It enhances the reputation of its trademark through high-quality merchandise. Therefore, it has been used for some time and has a certain market reputation. Strictly speaking, a free trademark that needs to be transferred for sale should be unlicensed.

If you are the transferor, when handling the transfer of your own trademark, you can publish the transfer information of your own trademark on the Internet to attract buyers to come for consultation. Or it can be handed over to a third-party trademark trading platform, which will be responsible for the transfer, sales and related procedures of its own trademarks, and will supervise and collect payments on its own.

However, this is clearly stipulated in my country’s Trademark Law. When transferring a registered trademark, the transferor and the transferee shall go to the Trademark Office to handle the matter of transferring the registered trademark. The proprietary trademark is also a registered trademark, and the transfer of the proprietary trademark requires going to the Trademark Office to go through the transfer procedures. The transfer process of a proprietary trademark is roughly as follows:

1. The trademark consultant confirms the intention of both parties to transfer the trademark, and drafts and signs a trademark transfer contract.

2. The transferor should notarize the trademark;

3. The transfer applicant has prepared all application documents.

4. The applicant submits application documents to the Trademark Office and pays the transfer fee.

5. The Trademark Office accepts the application and issues a "Notice of Acceptance";

6. After approval, the Trademark Office issues a "Registered Trademark Approval and Transfer Certificate" and makes an announcement.

In the process of transferring your own trademark, signing a trademark transfer contract is a very important step, because the trademark transfer contract will restrict the behavior of the buyer and seller in many aspects and provide protection for everyone's transfer transaction. So we can't ignore it.
