According to the relevant provisions of Article 40 of the new Trademark Law, if a registered trademark needs to be used continuously after its expiration, the trademark registrant shall go through the renewal procedures in accordance with the regulations within 12 months before its expiration; If it has not been handled during this period, it can be extended for six months. The validity period of each renewal registration shall be counted from the day after the last expiration of the trademark.
Compared with the old law, the Trademark Office extended the trademark renewal time of trademark registrants from the original 6 months to 12 months. The grace period after expiration is still 6 months.
