Legal analysis: From the definition of trademark, it refers to the use by producers and operators of goods on the goods they produce, manufacture, process, select or distribute, or the use by service providers on the services they provide. Text, graphics, letters, numbers, three-dimensional signs, color combinations, sounds, etc. used to distinguish the source of goods or services, or a combination of these elements to make them distinctive.

Legal basis: Article 10 of the "Trademark Law of the People's Republic of China" The following signs shall not be used as trademarks:

(1) The same as those of the People's Republic of China The country name, national flag, national emblem, military flag, and medals are the same or similar. The meaning, pronunciation or appearance of the trademark is similar to the name of our country, which may easily lead the public to mistake it for the name of our country. If the applicant is a foreigner or a foreign enterprise, and it is determined that the application is likely to cause misunderstanding to the public and has adverse effects, the application shall be rejected in accordance with Article 10, Paragraph 1, Item (8) of the Trademark Law.
