Article 1 In order to strengthen the supervision and management of advertising activities, promote the healthy and orderly development of the advertising industry, protect the legitimate rights and interests of consumers, and maintain social and economic order, in accordance with the "People's Republic of China and the State Advertising Regulations" "Act" and relevant laws and regulations, and combined with the actual conditions of this province, these regulations are formulated. Article 2 Advertisers, advertising operators, and advertising publishers shall abide by these regulations when engaging in advertising activities within the administrative region of our province. Article 3 The industrial and commercial administrative departments of provinces, cities, and counties (including county-level cities and districts, the same below) are the advertising supervision and management agencies. They implement hierarchical supervision and management of advertising. Their main responsibilities are:

(1) ) Organize and implement the supervision and management of advertising releases and other types of advertising activities;

(2) Organize and implement the review and approval of advertising operations and investigate and deal with illegal advertisements in accordance with the law;

(3) Guide advertising review The work of agencies and advertising industry organizations.

Urban construction, health, medicine, radio and television, foreign economic and trade, tourism, public security, education and other relevant departments shall, in accordance with their respective legal responsibilities, do a good job in supervision and management before advertising is released. Article 4 Advertisements must be true, legal, and comply with the requirements of the construction of socialist spiritual civilization. The language and measurement units used must comply with relevant national regulations. Article 5 Advertising shall not include the following false behaviors:

(1) Exaggerating the efficacy, performance, and function of the product;

(2) Falsely listing service items and standards;

(3) Adding unapproved content without authorization;

(4) Forging or falsely using the document number approved by the relevant administrative department;

(5) Make untrue promises about the goods sold and services provided;

(6) Other untrue promotions of goods and services. Article 6 Advertisements shall not have the following circumstances:

(1) Endangering national unity, sovereignty and territorial integrity;

(2) Using or disguised use of the national flag of the People's Republic of China and the People's Republic of China , national emblem, national anthem;

(3) Recommending and promoting goods or services in the name of state agencies (including institutions with administrative functions) and their staff;

(4) Containing Ethnic, racial, and gender discriminatory content;

(5) Publish advertisements about religious activities, supplies, and souvenirs in mass media and non-religious activity venues;

(6) Use Absolute terms such as national level, superlative, best, and top;

(7) Derogation of similar products;

(8) Other situations prohibited by laws and regulations. Article 7 To engage in advertising business activities, one must register in accordance with the law, obtain an "Advertising Business License" after approval by the advertising supervision and management authority.

For large-scale cultural, sports, public welfare activities and exhibitions, expositions, trade fairs, competitions, celebrations and other advertising-related activities, the organizer shall apply to the advertising supervision and management authority at the same level to obtain the "Temporary Sex Advertising Business License".

The "Advertising Business License" is subject to annual inspection. Legal persons, other economic organizations or individuals who receive an "Advertising Business License" shall go to the advertising supervision and management authority at the same level for annual inspection within the time limit specified by the provincial advertising supervision and management authority. Article 8 Advertisements for medicines, medical devices, pesticides, veterinary drugs and other commodities and other advertisements that are subject to review according to laws and regulations must be reviewed by the relevant administrative departments in accordance with laws and regulations before publication; without review, no advertisements shall be published. release.

Publishing advertisements for foreign labor cooperation, overseas travel, overseas study, agency procedures for going abroad, and academic education enrollment, etc., shall be reviewed by the provincial or authorized municipal foreign economic and trade, tourism, public security, and education administrative departments. Approved by the provincial advertising regulatory authority.

It is prohibited to publish and set up tobacco advertisements in mass media and various public places such as waiting rooms, theaters, sports competition venues, etc. Tobacco and alcohol advertisements shall be published and advertising screens shall be set up, subject to provincial advertising supervision. The administrative agency or the lower-level advertising supervision and administration agency authorized by it shall examine and approve it. Article 9 When mass media publish advertisements, they shall have clear advertising identification marks, which shall not be confused with non-advertising information, and shall not use other forms to disguise advertisements.

The advertising business of radio stations, television stations, and newspapers and periodical publishing units shall be handled by their agencies that specialize in advertising business, and registration of advertising operations shall be carried out in accordance with the law with the industrial and commercial administrative department at the same level.

Article 10 Any advertisements published in the form of posting, sending or mailing loose pages, books, bills, packaging, decoration and other types of printed matter shall be reviewed and registered by the advertising supervision and management authority at or above the city level or at the county level authorized by it. It is prohibited to distribute printed advertisements in residential buildings and traffic intersections. Article 11 It is prohibited to engage in the following behaviors in advertising activities:

(1) Disparaging the goods or services of other producers and operators;

(2) Using other people’s registered trademarks without authorization;

(3) Prize-based sales advertisements with a single bonus amount exceeding 5,000 yuan;

(4) Other behaviors prohibited by laws and regulations. Article 12 The use of buildings and spaces in streets, squares, stations, docks and other places to engage in outdoor advertising activities shall comply with the outdoor advertising setting plan. The plans for setting up outdoor advertisements shall be formulated by the local city and county people's governments, organized by relevant departments such as industrial and commercial administration, urban construction, environmental protection, and public security, and the advertising supervision and management agencies shall be responsible for the supervision and implementation.
