What is the Polish trademark objection?

When the Polish Patent Office conducts a substantive examination of a trademark application, it will only examine the absolute reasons, and will only notify the trademark applicant of the relative reasons. If the prior right holder raises an objection to a trademark, it can only do so on grounds relative to the trademark. The relative reasons are as follows:

1. Having prior rights (including trademarks or other personal or property rights);

2. Having obtained prior rights with others for identical or similar goods. The protected trademark rights are identical or similar, and there is a risk of misleading the public, especially the risk of linking the trademark with a previous trademark;

3. Already have obtained well-known trademark rights for any goods with others Identical or similar, if the submitted trademark has no reasonable grounds and its use will bring unfair benefits to the applicant, or damage the uniqueness or reputation of the earlier well-known trademark;

4. Priority with the application If the trademark is identical or similar to a trademark that was already familiar in Poland before the date of the right, if there is a risk of misleading the public, in particular, there is a risk of linking the trademark with an earlier trademark.
