Article 3 "Motor-assisted bicycles" as mentioned in these regulations refer to two-wheeled bicycles that are driven by a small gasoline engine and have a pedal-driven function.
Article 4: Moped-assisted bicycles must meet the following main technical requirements:
(1) The working volume of the gasoline engine does not exceed 36 cubic centimeters;
(2) The maximum design driving speed does not exceed 24 kilometers per hour;
(3) Major safety equipment such as brakes, steering gear, bell or horn, headlights and rear reflectors are complete and effective;
(4) The diameter of the wheel shall not be greater than 660 mm and not less than 510 mm.
If national standards provide otherwise, the national standards shall prevail.
Article 5 Moped-assisted bicycles traveling on the roads of this city must be inspected by the district or county public security traffic management department and apply for a moped-assisted bicycle license (including number plate and driving license). Moped-assisted bicycles without license plates or with invalid license plates are not allowed to drive on the roads of this city.
Article 6 Only the moped-assisted bicycles listed in the "Catalogue of Moped-assisted Bicycle Products Allowed to Apply for Licenses in this City" (hereinafter referred to as the "Product Catalog") can apply for a license in this city.
Anyone who applies to include the moped-assisted bicycles manufactured by the unit in the "Product Catalog" shall submit the product's registered trademark and a quality inspection report issued by a bicycle product quality inspection agency at or above the provincial level to the municipal public security and transportation management department. and technical appraisal report. Moped-assisted bicycles that have passed the review will be included in the "Product Catalog" by the municipal public security and traffic management department, and will be announced to the public on a regular basis. After spot checks by the municipal technical supervision department, the moped-assisted bicycles were found to be of unqualified quality after two inspections and were removed from the "Product Catalog" by the municipal public security and traffic management department.
Article 7 Distributors who sell power-assisted bicycles that have not been included in the "Product Catalog" by the municipal public security and traffic management department shall inform the buyers in an effective manner before completing the transaction that the product cannot apply for a license in this city. .
Article 8 Anyone applying for a moped-assisted bicycle license in this city must purchase a moped-assisted bicycle third-party liability insurance from an insurance institution approved by the insurance authority to operate statutory insurance business in this city, and in accordance with the Provides for the payment of vehicle and vessel use tax.
Article 9 To apply for a moped-assisted bicycle license in this city, the owner must be over 16 years old and have a permanent residence in this city.
Article 10 If you comply with the provisions of paragraph 1 of Article 12 of these Regulations and apply for a moped bicycle license, you must submit an application to the district or county public security and traffic management department where your permanent residence is located.
When applying for a moped bicycle license, the owner should provide the following materials:
(1) This city’s resident ID card;
(2) Vehicle purchase invoice or Other legal source certificates for the assistive bicycle;
(3) Factory certificate of the assistive bicycle;
(4) Third-party liability insurance for the assistive bicycle issued by the city’s insurance agency Voucher;
(5) Vehicle and vessel use tax payment voucher.
Article 11 Motor-assisted bicycle license plates are divided into the following two categories:
(1) Urban license plates;
(2) Suburban license plates.
The number plate must be installed at a fixed position at the front end of the handlebar.
Article 12 Permanent residents of various counties and Pudong New Area (areas outside the inner ring road), Baoshan District, Jiading District, and Minhang District can apply for a suburban license plate for assistive bicycles.
In addition to the city number plates for power-assisted bicycles that have already been received, this city will no longer issue city number plates for power-assisted bicycles.
After a moped with a city license plate is scrapped, its city license plate will be cancelled.
Article 13: Moped-assisted bicycles with urban license plates are allowed to drive on roads within the city; moped-assisted bicycles with suburban license plates are only allowed to drive on roads outside the city's inner ring line. travel. The municipal public security and traffic management department may narrow the scope of mobility-assisted bicycles based on the city's road traffic conditions.
Moped-assisted bicycles with non-local license plates are not allowed to drive on the roads of this city.
Article 14 Moped-assisted bicycle drivers must be at least 16 years old, have no physical defects that hinder safe driving, and receive training on traffic regulations and driving operation techniques and pass the examination of the public security and traffic management department. Only with an operator's license can you drive on the road. Anyone holding a motorcycle or moped driving license is allowed to drive a moped.
Article 15: Moped-assisted bicycles must be inspected within the time limit specified by the public security and traffic management department. Vehicles that fail to undergo inspection as required or fail to pass the inspection are not allowed to drive on the road.
Article 16 Moped-assisted bicycle drivers must accept inspection by the public security and traffic management department within the prescribed period. Those who fail to undergo inspection in accordance with regulations or fail to pass the inspection are not allowed to drive power-assisted bicycles.
Article 17 To apply for a moped-assisted bicycle license plate, the owner must pay license fees and other fees in accordance with regulations. The specific charging items and standards shall be proposed by the Municipal Public Security Bureau and shall be determined by the Municipal Price Department in conjunction with the Municipal Finance Department. Approval.
Article 18 This city implements total control over the number of suburban license plates issued for moped bicycles, and the specific number is determined by the Municipal Public Security Bureau in conjunction with the Municipal Environmental Protection Bureau.
For moped-assisted bicycles that have obtained license plates, the municipal public security and traffic management department may gradually take scrapping measures based on their service life and safety and technical conditions. The scrapping regulations for moped-assisted bicycles shall be formulated by the Municipal Public Security Bureau in conjunction with relevant departments and submitted to the Municipal People's Government for approval.
Article 19 Motor-assisted bicycle drivers must abide by the following regulations:
(1) Carry their driving license and operating permit when driving;
(2) ) It is not allowed to drive on the motor vehicle lane;
(3) It is not allowed to drive a power-assisted bicycle with incomplete safety equipment or failed safety parts;
(4) It is not allowed to drive into the machine Special roads for high-speed trains;
(5) People and towed vehicles are not allowed;
(6) The weight of loaded items is not allowed to exceed 30 kilograms, and the height from the ground is not allowed to exceed 1.5 meters , the length is not allowed to exceed the body, and the width is not allowed to exceed the handlebar;
(7) It is not allowed to lend, alter or forge driving licenses and operating certificates;
(8) Not allowed when drunk quasi-driving.
Article 20 Moped-assisted bicycles with urban license plates shall not be transferred to persons with permanent residence in urban areas other than Pudong New Area (areas outside the Inner Ring Road), Baoshan District, Jiading District and Minhang District. ; Transfer the ownership to a transferee who meets the conditions for applying for a suburban license plate, and the urban license plate after transfer will be replaced by a suburban license plate.
A moped with a suburban license plate can be transferred to a transferee who meets the conditions for applying for a suburban license plate, but it cannot be transferred to a person with a permanent residence in the urban area.
The transfer of a power-assisted bicycle must be done through a swap shop, used car trading market or auction house. After the transfer of the moped-assisted bicycle, the transferee shall apply to the public security and traffic management department for transfer procedures with the city's resident ID card, the transfer transaction certificate and the transferor's certificate of return of the license plate.
Article 21 Anyone who violates the provisions of Article 5 and Article 14 of these Regulations shall be fined not more than 200 yuan.
Article 22 Anyone who violates Article 13 of these Regulations shall be fined not more than 50 yuan.
Article 23 Anyone who violates Articles 15 and 16 of these Regulations shall be fined not more than 100 yuan.
Article 24 Anyone who violates the provisions of Items (1) and (2) of Article 19 of these Regulations shall be fined 20 yuan; anyone who violates Items (3) to Items of Article 19 Those who violate the provisions of Item (6) shall be fined not more than 50 yuan; those who violate the provisions of Items (7) and (8) of Article 19 shall be fined not more than 200 Yuan.
Article 25 Anyone who violates these regulations and installs a gasoline engine or other driving device on a bicycle without authorization shall be fined not more than 200 yuan, and the gasoline engine or other driving device shall be confiscated.
Article 26 If the party concerned is dissatisfied with the administrative penalty imposed by the public security and traffic management department, he may apply for reconsideration to the higher-level public security department within 5 days after receiving the penalty decision; A reconsideration decision shall be made within 5 days after the application for reconsideration is submitted. If the party concerned is dissatisfied with the reconsideration decision, he may file a lawsuit with the People's Court within 5 days after receiving the reconsideration decision.
Article 27 Relevant matters not provided for in these regulations shall be governed by other relevant traffic management laws and regulations.
Article 28 The Shanghai Public Security Bureau shall organize the implementation and be responsible for the interpretation of these regulations.
Article 29 These regulations will come into effect on November 1, 1993.
