Since the promulgation and implementation of the Regulations on the Safety Management of Fireworks and Firecrackers in p>26, all regions and relevant departments have conscientiously implemented the decision-making arrangements of the State Council and adopted a series of effective measures to strengthen the safety management of fireworks and firecrackers. Fireworks and firecrackers accidents have greatly decreased in China, but in some places, illegal production, operation, transportation and discharge of fireworks and firecrackers are still prohibited repeatedly, and accidents occur from time to time, causing serious losses to people's lives and property. In order to thoroughly implement the spirit of the Notice of the State Council on Further Strengthening the Work of Enterprise Safety in Production (Guo Fa [21] No.23), effectively strengthen the safety supervision of fireworks and firecrackers, and effectively curb the occurrence of fireworks and firecrackers safety accidents, the following opinions are put forward: (1) Strictly control the safety production of fireworks and firecrackers. Scientifically formulate the development plan of fireworks and firecrackers industry, strictly control the access conditions of fireworks and firecrackers industry, and reasonably control the number of production enterprises. Actively promote enterprises to carry out safety transformation in accordance with relevant national standards and norms, and eliminate backward production processes, technologies and equipment. Strictly control the safety production license, and those who do not meet the requirements of the local fireworks industry development plan and the relevant national safety technical standards will not be allowed. By the end of the Twelfth Five-Year Plan, the number of fireworks and firecrackers production enterprises in China will be reduced by 2% compared with the end of the Eleventh Five-Year Plan.

(2) Strictly control the production of high-risk products such as fireworks bombs. Carry out special management of fireworks products, strictly control the safety production standards and production conditions of high-risk products such as fireworks, strictly control the number of fireworks production enterprises, prohibit the production of products with high drug sensitivity, large dosage and no fixed trajectory, and eliminate products with serious environmental pollution. Establish a national record publicity and unified product identification registration management system for fireworks bomb production enterprises, and strictly control the whole process of fireworks bomb production, sales, transportation, discharge and import and export. A-level products such as fireworks bombs are directly sold or exported by production enterprises to units approved by public security organs.

(3) Strengthen the safety supervision of fireworks drugs and semi-finished products. Strictly manage the production, sales and transportation of black powder, pyrotechnics and fuse, and in principle, black powder and fuse shall not be transported across provinces for a long distance. It is forbidden to sell and buy pyrotechnics and semi-finished products of fireworks and firecrackers containing drugs, and it is forbidden to use retired double (multi) base propellant or directly use retired single base propellant to produce fireworks and firecrackers. In accordance with the law, potassium chlorate will be included in the scope of supervision of dangerous chemicals that are easy to produce explosives, and the flow direction of sales, purchase and use will be strictly registered. It is strictly forbidden to use potassium chlorate to produce fireworks and firecrackers.

(4) Strengthen the management of quality standards and packaging labels of fireworks and firecrackers. The quality inspection department shall, in conjunction with the safety supervision, public security and other relevant departments, timely organize the revision of relevant product quality and technical standards, scientifically classify and grade products, strictly stipulate important safety technical indicators such as product types, specifications and dosage, and cancel the dangerous product varieties such as small fireworks, friction, smoke and inner-barrel combined fireworks set off by individuals. Product packaging must make complete and clear marks on dosage, grade, production date and discharge requirements.

(5) Strengthen the quality supervision and spot check of fireworks and firecrackers. The quality inspection department should strengthen the quality supervision and spot check of fireworks and firecrackers. The production enterprises that find unqualified products through supervision and spot check should be ordered to seriously rectify and review within a time limit in strict accordance with the relevant regulations, and the unqualified products and enterprises will be notified to the relevant departments in time, and the unqualified products and related production enterprises should be handled well. (1) Strict market access for fireworks and firecrackers. Reasonable layout of fireworks wholesale enterprises and retail outlets. Enterprises and operators engaged in the wholesale and retail of fireworks and firecrackers must obtain a business license issued by the safety production supervision and management department before issuing a business license. For an enterprise or operator whose business license has been cancelled, the safety production supervision and management department shall notify the administrative department for industry and commerce within five working days after the cancellation of the license, and the administrative department for industry and commerce shall cancel the registration or revoke the business license, or order the parties concerned to handle the change registration according to law. The administrative department for industry and commerce should intensify market inspection and investigate and deal with illegal acts such as unlicensed operation, counterfeit trademark infringement and false propaganda according to law.

(2) Improve the purchase and sale contract system of fireworks and firecrackers. To further strengthen the management of fireworks purchase and sale contracts, production and wholesale enterprises must sign a written purchase and sale contract when buying and selling fireworks and firecrackers, and carefully check the relevant qualifications. It is strictly forbidden to sell or buy fake and shoddy fireworks and firecrackers. Fireworks and firecrackers production enterprises shall not buy fireworks and firecrackers from other production and operation enterprises and sell them or affix the logo of the enterprise for sale. Fireworks wholesale enterprises and retail outlets shall not sell Grade A products such as fireworks bombs.

(3) Strengthen the information management of fireworks and firecrackers. Fireworks production and operation enterprises shall, in accordance with the relevant requirements, establish and improve the purchase and sales registration system, and the registration records shall be kept for at least two years for future reference. Accelerate the establishment of a national unified fireworks flow management information system, effectively supervise the production, sales, transportation, discharge, import and export flow of fireworks bombs, and gradually realize the information supervision of all fireworks products, black powder, fuse and important dangerous raw materials. (a) strict fireworks road transport license management system. Where the road transport of fireworks, fireworks road transport license must be held. When issuing the Permit for Road Transport of Fireworks and Firecrackers, the county-level public security organ at the place of arrival shall strictly examine the materials submitted by the shipper in accordance with the procedures, time limits and conditions stipulated by relevant laws and regulations, and check the qualification certificate of the supplier engaged in the production and operation of fireworks and firecrackers. Do not meet the conditions, shall not be issued "fireworks road transport permit". Public security organs should earnestly strengthen the supervision and inspection of road transport fireworks and firecrackers, and severely investigate and deal with illegal and illegal transport acts according to law.

(2) Strengthen the management of fireworks transport vehicles and related personnel. Road transport of fireworks and firecrackers must use dangerous goods transport vehicles that meet the safety requirements, and install a satellite positioning system with driving record function to monitor the whole process of transportation. Carriers, transport vehicles, drivers and escorts must hold relevant qualifications and qualification certificates issued by the transportation department. Transportation departments should strictly supervise fireworks carriers, transport vehicles, drivers and escorts.

(3) Strengthen the export safety management of fireworks and firecrackers. The transportation department shall strengthen the safety supervision and ship fitness audit on the loading and temporary storage of fireworks and firecrackers in export ports. The quality inspection and customs departments shall strengthen the product quality inspection, packing supervision and customs clearance inspection of exported fireworks and firecrackers. The commerce department shall cooperate with relevant law enforcement departments to strengthen the supervision and management of enterprises engaged in the production and operation of fireworks and firecrackers, and severely punish enterprises that have been found by law enforcement departments to be in violation of laws and regulations. (a) improve the classification management system of large-scale fireworks display activities. Public security departments should formulate measures for the hierarchical management of large-scale fireworks display activities, strengthen the safety management of fireworks display activities in accordance with the law, strictly examine and approve large-scale fireworks display activities, strictly examine the qualifications of fireworks display operation units and operators, and assist the organizers in doing a good job in security, fire rescue and vigilance. Temporary storage places for fireworks and firecrackers required for large-scale fireworks display activities must comply with safety regulations and try to shorten the storage time. For illegal discharge, the responsibility of the relevant personnel should be seriously investigated.

(2) Strengthen the safety management and publicity and education for the people to set off fireworks and firecrackers. All regions and relevant departments should strengthen the safety management of fireworks and firecrackers for the masses, strengthen the publicity and popularization of safety discharge knowledge, make full use of the news media, primary and secondary school education and other means to widely publicize the laws, regulations, standards and common sense of fireworks and firecrackers, and guide the masses to consciously resist counterfeit and shoddy products and safely discharge fireworks and firecrackers. (a) improve the mechanism to crack down on illegal production and operation of fireworks. Public security, safety supervision, quality inspection, industry and commerce, transportation and other departments at all levels should establish a joint law enforcement mechanism under the unified leadership of the people's government at the same level, and carry out law enforcement inspections in close cooperation according to the division of responsibilities. The people's governments at the county and township levels in the traditional producing areas of fireworks and firecrackers and areas with outstanding problems should further strengthen the organization and leadership in cracking down on illegal production and business operations (hereinafter referred to as "cracking down on illegal publications"), with the main leaders of the government taking overall responsibility, taking the lead in charge of the leaders, always maintaining a high-pressure situation, organizing and carrying out the "cracking down on illegal publications" action, and announcing the tip-off telephone number to the public, and establishing a reward system for the masses to report.

(2) crack down on illegal activities involving fireworks. Units or individuals engaged in illegal production, operation, transportation, discharge, import and export of fireworks and firecrackers should be severely punished according to laws and regulations; If a crime is constituted, criminal responsibility shall be investigated according to law. The illegal production and operation dens found should be banned according to law, and traced back to the source to find out the economic chain that cut off the supply of illegal raw materials and product sales. For accidents caused by the failure to implement the duties of "fighting illegal publications" and the ineffective work, the relevant units and personnel should be held accountable. All regions should study and formulate relevant policies, encourage the intensive development of fireworks and firecrackers industry, support economically backward areas to be equipped with explosives detectors and other necessary equipment, and strengthen the ability to fight illegal publications. (a) strictly implement the main responsibility of enterprise safety production. The main person in charge of fireworks production and operation enterprises is the first person in charge of safety production, and it is necessary to strengthen the leadership over safety production. We will comprehensively promote the standardization of production safety, establish and improve the rules and regulations on production safety management, increase investment in safety, build and improve important safety facilities such as safety barriers, lightning protection, fire prevention and anti-static, continue to carry out in-depth investigation and management of hidden dangers, and eliminate all kinds of hidden dangers in time. It is strictly forbidden to exceed the scope, personnel, dosage and change the use of workshops without authorization. It is strictly forbidden to subcontract enterprises or production lines, and it is strictly forbidden to use child workers and students. It is strictly forbidden to strengthen the system of holding certificates in dangerous production processes, and put an end to "one license for many factories" and illegal transfer of safety production licenses in the form of subcontracting, reselling and renting without authorization.

(2) Strengthen the coordination and cooperation of relevant departments. Establish an inter-ministerial joint meeting system of fireworks and firecrackers safety supervision led by the General Administration of Safety Supervision and attended by public security, quality inspection, industry and commerce, transportation, commerce, customs and other departments, regularly analyze and report the situation of fireworks and firecrackers safety production, study, coordinate and solve important issues of fireworks and firecrackers safety supervision, and organize joint law enforcement and special rectification of departments. All regions should also establish corresponding departmental coordination mechanisms, and regularly carry out safety supervision and inspection according to the characteristics and laws of fireworks production, management, transportation and discharge. It is necessary to give full play to the guidance and self-discipline of industry associations and guide the healthy and safe development of fireworks and firecrackers industry.

(3) Seriously investigate and deal with all kinds of fireworks accidents. All fireworks and firecrackers production and operation enterprises that have casualty accidents shall stop production and suspend business for rectification, eliminate hidden dangers within a time limit, and resume production and operation only after passing the acceptance of local safety supervision departments. Fireworks production and operation enterprises that have suffered a fatal accident involving more than three people shall stop production and suspend business for rectification and re-examine the conditions for safe production according to law. If the conditions for safe production no longer exist, the safety production license or business license shall be revoked according to law.
