1. Application conditions

Trademark If a registrant applies to cancel his registered trademark or cancel the registration of his trademark on some designated goods, he should go to the Trademark Office to go through the cancellation procedures of the registered trademark.

If a trademark registrant applies to cancel its registered trademark or cancel the registration of its trademark on some designated goods, and the cancellation is approved by the Trademark Office, the exclusive right to use the registered trademark or the exclusive right to use the registered trademark will not apply to that part of the designated goods. The validity of the above shall terminate on the date when the Trademark Office receives its cancellation application.

There is no fee required to apply for cancellation of a registered trademark.

5. Process and application materials

(5) If the application documents are in a foreign language, a Chinese translation should also be provided.

2. Specific instructions

(1) Fill in the application form one by one and must be typed or printed. If the applicant is a natural person, the ID number should be filled in after the name.

(2) Fill in a trademark registration number in one application form.

(3) If a trademark agency is entrusted to handle the matter, a trademark agency power of attorney should be submitted.

(4) If the trademark applied for cancellation is an owned trademark, the application should be made in the name of the representative.

(5) If the name of the registrant has changed, when applying for trademark cancellation, the application should be made in the changed name, and a change certificate issued by the competent registration department should be submitted at the same time. The proof of change can be a copy of the registration authority's change approval document or the relevant files downloaded and printed from the registration authority's official website.

(6) The application for cancellation must be a registered trademark. Trademarks under pledge and seizure can only be canceled with the consent of the pledgee. Trademarks under the following circumstances cannot be approved for cancellation:

A. Trademarks in opposition, opposition review, and litigation

B. Trademarks that have expired but are still within the extension period< /p>

C. Trademarks under freezing

2. If a trademark agency is entrusted to handle the application, the trademark agency will deliver the application documents to the Trademark Office.

VI. Notes

1. If a registered trademark is cancelled, the original "Trademark Registration Certificate" will be invalidated and announced; the trademark registrant applies to cancel the use of his trademark on some designated goods. If the registration is successful, a new "Trademark Registration Certificate" will be issued and announced. If the application is processed directly, it will be sent to the applicant by mail according to the address filled in the application form; if it is processed through an agent, it will be sent to the agency organization.

2. If the cancellation application is disapproved, the Trademark Office will issue a "Notice of Disapproval". If the application is processed directly, it will be sent to the applicant by mail according to the address filled in the application form; if it is processed through an agent, it will be sent to the agency organization.

3. The category of the application should be filled in according to the international classification category approved by the "Trademark Registration Certificate".
