Chapter 1 General Provisions Article 1 In order to strengthen the supervision and management of product quality, promote the improvement of product quality, clarify product quality responsibilities, protect the legitimate rights and interests of users and consumers, and maintain social and economic order, according to " These regulations are formulated in accordance with the "People's Republic of China and Domestic Product Quality Law" and relevant laws and regulations, in combination with the actual conditions of this province. Article 2: Those engaged in product production and sales (including installation and repair) activities within the administrative region of this province must abide by these regulations.
The products referred to in these regulations refer to products that have been processed, produced and sold.
This regulation does not apply to construction projects. Article 3 The technical supervision departments of the people's governments at or above the county level are responsible for the supervision and management of product quality within their respective administrative regions.
Relevant departments of the people's governments at or above the county level are responsible for product quality supervision and management within their respective scope of responsibilities.
People's governments at or above the county level and relevant departments should implement a product quality reward system to encourage and guide enterprises to improve product quality. Article 4 Producers and sellers should establish and improve quality management systems, strengthen quality management, ensure product quality, and assume product quality responsibilities. Article 5 Users and consumers have the right to inquire about product quality issues with the producers and sellers of the products; to lodge complaints with the technical supervision department, the industrial and commercial administration department and relevant departments, and the relevant departments shall be responsible for handling them. Chapter 2 Product Quality Supervision and Inspection Article 6 Product quality supervision and inspection implements the systems of supervision and spot inspection, unified supervision and inspection, regular supervision and inspection and daily supervision and inspection.
The focus of supervision and spot inspections is to inspect products that may endanger human health and personal and property safety, important industrial products that affect the national economy and people's livelihood, and products that have quality problems reported by users, consumers, and relevant organizations. Unified supervision and inspection is a province-wide inspection of certain types of products based on national needs and social requirements. Periodic supervisory inspections are inspections carried out according to a determined periodic inspection plan and inspection cycle. Routine supervision and inspection are inspections of quality problems that are discovered daily and reported, complained and reflected by the people. Supervision and spot checks, unified supervision and inspection, and regular supervision and inspection plans are implemented in a unified manner to avoid repeated inspections and reduce the burden on enterprises. The technical supervision department of the Provincial People's Government is responsible for formulating and organizing the implementation of the province's product quality supervision and inspection plan. The formulation and adjustment of product quality supervision and inspection plans by the technical supervision departments of the people's governments at or above the county level and relevant departments of the provincial people's governments shall be submitted to the technical supervision departments of the provincial people's governments for unified coordination and approval before implementation. Supervision and inspection without unified coordination and approval shall not be carried out, and the person being inspected has the right to refuse.
The technical supervision department can directly implement daily supervision and inspection. Article 7 The basis for product quality supervision and inspection is national standards, industry standards, local standards or registered enterprise standards, quality-related clauses in economic contracts, and product quality commitments expressed in the form of product descriptions, physical samples, etc. Article 8 The results of product quality supervision and inspection shall be informed to the inspected persons and announced in an appropriate manner.
If the quality of products fails to pass the supervision and inspection, the enterprise should actively make rectifications. The relevant departments are responsible for the implementation of rectification measures; the technical supervision department is responsible for supervision and inspection; the technical supervision department is responsible for the re-inspection of product quality after rectification. Article 9 Product quality inspection shall be the responsibility of product quality inspection institutions established in accordance with the law by the technical supervision departments of the people's governments at or above the county level and product quality inspection institutions authorized by the technical supervision departments of the provincial people's governments in accordance with the law.
Product quality inspection agencies must have corresponding testing conditions and capabilities, and can only undertake product quality inspection work after being assessed and approved by the technical supervision department of the Provincial People's Government. Product quality inspection agencies conduct assessments and re-examinations every three to five years.
When handling product quality disputes, the inspection report issued by the product quality inspection agency specified in the previous paragraph shall prevail.
The product quality inspection agency shall be responsible for the inspection report issued. Article 10 If the person being inspected has objections to the inspection results, he or she may apply in writing to the superior technical supervision department for re-inspection within fifteen days from the date of receipt of the inspection results.
The technical supervision department shall designate the relevant product quality inspection agency to conduct re-inspection within ten days from the date of receipt of the re-inspection application. The re-inspection conclusion of the product quality inspection agency designated by the provincial technical supervision department shall be the final inspection conclusion. Article 11 The inspection fees required for supervision and spot inspections conducted by technical supervision departments shall be settled by financial allocations of the people's governments at all levels. Inspection fees required for unified supervision and inspection, periodic supervision and inspection, and daily supervision and inspection shall be charged to the inspected in accordance with relevant national regulations.
Samples required for product quality supervision and inspection shall be taken by quality supervision and inspection personnel in specified quantities from the inspected persons with the product quality supervision and inspection certificate. After the inspection is completed and the sample retention period expires, the samples should be returned to the person being inspected, unless there is loss or otherwise stipulated by the state. Article 12 Product quality liability issues arising in the field of production and circulation shall be investigated and dealt with by the technical supervision department; illegal acts found in the production and distribution of adulterated and counterfeit products during market management and trademark management shall be investigated and dealt with by the industrial and commercial administration department ; The technical supervision department and the industrial and commercial administrative department who discover the illegal acts of reselling or fraudulently selling inferior products in the market are responsible for investigating and punishing them. The same illegal act shall not be punished repeatedly. Article 13 When product quality supervision administrative law enforcement personnel perform official duties, they should produce their administrative law enforcement certificates and strictly follow the prescribed procedures.
The management of fined and confiscated income shall be carried out in accordance with relevant national regulations.
