Fees for trademark transfer

A transfer application requires a transfer fee of 1,000 yuan.

If a trademark agency is entrusted to handle the matter, the applicant shall pay the transfer fees and agency fees to the trademark agency. The transfer fees collected by the Trademark Office will be deducted from the advance payment of the trademark agency.

The difference between trademark transfer and trademark change:

The transfer of a registered trademark is different from changing the name of the registrant. When the name of the registrant is changed, the subject of the registered trademark does not change, only the name of the registrant changes. When a registered trademark is transferred, its subject has changed, and the owner of the transferred trademark is no longer the original registrant. In the former case, for example, if the name of a trademark registrant (enterprise) changes, only the change registration is required; in the latter case, if the trademark registrant (enterprise) converts a partnership into a limited liability company, although its enterprise name and address have not changed, However, it has essentially been transformed into a new corporate legal person, so the transfer registration procedures should be completed.

After the trademark is transferred, the ownership of the trademark also changes. When a company's name or address changes, the ownership of the trademark does not change. Trademark changes also require that all trademarks registered by the registrant must be registered together for change. The transfer of registered trademarks can be handled separately, unless the trademark to be transferred is similar to other untransferred trademarks and needs to be transferred together, the others do not need to be transferred together.

Notes on trademark transfer:

1. If a registered trademark is transferred, the trademark registrant shall transfer the same or similar trademark registered on the same or similar goods together.

2. One month after the transfer application is submitted, the Trademark Office will send the "Notice of Acceptance" to the transferee by mail according to the address filled in the application form. At the same time, according to the transferred trademark recorded in the Trademark Office A copy of the "Notice of Acceptance" will be sent to the registrant's address.

3. If the transfer application does not comply with legal requirements, the Trademark Office will notify the applicant in writing by mail to make corrections within a time limit according to the address filled in on the application.

4. After the transfer application is approved, the Trademark Office will send the transfer certificate to the transferee by mail according to the address filled in the application form, and publish an announcement on the transfer of the trademark. The date of signature on the certificate is the date of announcement, and the assignee shall enjoy the exclusive right to use the trademark from that date.

5. If the transfer application cannot be approved due to other reasons, the Trademark Office will notify the applicant in writing by mail according to the address filled in the application form.

6. If there are multiple transferees in the transfer application***, the relevant notice or certificate from the Trademark Office will only be issued to the representative. If anyone else needs proof, they should apply for a reissue.

8. The category of the application should be filled in according to the international classification category approved by the "Trademark Registration Certificate".

9. Things to note when natural persons apply for trademark registration

There are two ways to apply for transfer of registered trademarks:

(1) Entrust a nationally recognized trademark agency to handle the application ;

(2) Applicants should go directly to the trademark registration hall of the Trademark Office to apply.
