Article 1 In order to strengthen the management of the printing industry, safeguard the legitimate rights and interests of printing operators and social public interests, and promote socialist spiritual and material civilization.

article 2 these regulations are applicable to the printing business activities of publications, packaging and decoration printed materials and other printed materials.

publications mentioned in these regulations include newspapers, periodicals, books, maps, New Year pictures, pictures, calendars, picture albums, audio-visual products, binding covers of electronic publications, etc.

the printed matter of packaging and decoration as mentioned in these regulations includes trademarks, advertising materials and printed matter of paper, metal, plastic, etc. used as product packaging and decoration.

other printed materials mentioned in these regulations include documents, materials, charts, tickets, certificates, business cards, etc.

the printing business activities mentioned in these regulations include business activities such as typesetting, plate making, printing, binding, photocopying, photocopying and printing.

article 3 operators of printing industry must abide by relevant laws, regulations and rules, and stress social benefits.

it is forbidden to print publications, packaging and decoration printed materials and other printed materials containing reactionary, obscene and superstitious contents and other contents explicitly prohibited by the state.

Article 4 The administrative department of publishing in the State Council is in charge of the supervision and administration of the printing industry throughout the country. The administrative departments in charge of publication administration of local people's governments at or above the county level (hereinafter referred to as the administrative departments of publication) are responsible for the supervision and administration of the printing industry within their respective administrative areas.

the public security departments, industrial and commercial administrative departments and other relevant departments of the people's governments at or above the county level shall be responsible for the supervision and administration of the printing industry within their respective functions and duties.

Article 5 A printing operator shall establish and improve a printing verification system, a printing registration system, a printing storage system, a printing delivery system and a printing activity defective product destruction system. The specific measures shall be formulated by the publishing administrative department of the State Council in conjunction with the public security department of the State Council.

when printing operators find illegal and criminal acts in their printing business activities, they should report to the public security department or the publishing administrative department in time.

article 6 social organizations in the printing industry shall, in accordance with their articles of association and under the guidance of the publishing administrative department, implement self-discipline management. Establishment of printing enterprises

article 7 the state practices a printing business license system. No unit or individual may engage in printing business activities without obtaining a printing business license in accordance with the provisions of these regulations.

Article 8 To set up a printing enterprise, the following conditions shall be met:

(1) Having the name and articles of association of the enterprise;

(2) having a definite business scope;

(3) It has a place for production and business operation that meets the needs of its business scope and the necessary conditions for production and business operation such as funds and equipment;

(4) Having an organization and personnel that meet the needs of its business scope;

(5) Other conditions stipulated by relevant laws and administrative regulations.

the examination and approval of the establishment of a printing enterprise shall not only comply with the provisions of the preceding paragraph, but also conform to the state's plans on the total number, structure and layout of printing enterprises.

article 9 to establish an enterprise engaged in the printing business of publications, packaging and decoration printed matter and other printed matter, an application shall be submitted to the publishing administrative department of the people's government of the province, autonomous region or municipality directly under the central government where it is located; Among them, the establishment of an enterprise specializing in business card printing shall apply to the publishing administrative department of the local people's government at the county level. After examination and approval, the applicant has obtained a printing business license; And in accordance with the relevant provisions of the state, apply to the public security department with a printing business license, and after approval, obtain a special trade license, apply to the administrative department for industry and commerce for registration with a printing business license and a special trade license, and obtain a business license.

individuals are not allowed to engage in printing business activities of publications, packaging and decoration printed matter; Individuals engaged in other printed matter printing business activities shall go through the examination and approval procedures in accordance with the provisions of the preceding paragraph.

article 1 when accepting an application for establishing an enterprise engaged in printing business, the publishing administrative department shall make a decision of approval or disapproval within 6 days from the date of receiving the application. If the application for establishment is approved, a printing business license shall be issued; If the application for establishment is not approved, it shall notify the applicant and explain the reasons.

the printing business license shall indicate the types of printing business activities that the printing enterprise is engaged in.

the printing business license shall not be sold, leased, lent or transferred in other forms.

article 11 when a printing business operator applies to run or change its business activities of printing publications, packaged and decorated printed matter or other printed matter, or merges with other printing business operators, or establishes a new printing business operator due to merger or division, it shall go through the formalities in accordance with the provisions of article 9 of these regulations.

when a printing business operator changes its name, legal representative or person in charge, domicile or business premises and other major registered items, or terminates its printing business activities, it shall go through the formalities of change and cancellation of registration with the public security department and the administrative department for industry and commerce that originally registered, and report to the publishing administrative department that originally approved the establishment for the record.

article 12 the state allows the establishment of Chinese-foreign joint venture printing enterprises and Chinese-foreign cooperative printing enterprises, and allows the establishment of foreign-funded enterprises engaged in the printing business of packaging and decoration printed matter. The specific measures shall be formulated by the publishing administrative department of the State Council in conjunction with the foreign economic relations and trade department of the State Council.

Article 13 If a printing factory (institute) is established within a unit, it must go through the registration formalities with the publishing administrative department of the local people's government at or above the county level, and file with the public security department in accordance with relevant state regulations; If a printing factory (institute) established within a unit prints printed copies involving state secrets, it shall also go through the registration formalities with the secrecy department.

the printing factory (institute) established within the unit shall not engage in printing business activities; Engaged in printing business activities, must go through the formalities in accordance with the provisions of this chapter. Printing of publications

article 14 the state encourages enterprises engaged in publication printing to print publications that reflect new outstanding cultural achievements at home and abroad in a timely manner, and attaches importance to printing fine traditional cultural products and valuable academic works.

article 15 an enterprise engaged in publication printing business activities shall not print publications that are explicitly prohibited by the state or publications published by non-publishing units.

article 16 when printing publications, the entrusting printing unit and the printing enterprise shall sign printing contracts in accordance with the relevant provisions of the state.

Article 17 When a printing enterprise accepts the entrustment of a publishing entity to print books and periodicals, it must verify and store the power of attorney for printing stamped by the publishing entity, and report it to the publishing administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government for the record before printing; If a printing enterprise accepts the entrustment of a publishing unit other than the local province, autonomous region or municipality directly under the Central Government to print books and periodicals, the power of attorney for printing must also be reported to the publishing administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government for the record in advance. The printed power of attorney shall be in a unified format prescribed by the publishing administrative department of the State Council, and shall be uniformly printed by the publishing administrative department of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.

if a printing enterprise accepts the entrustment of a publishing unit to print a newspaper, it must verify the newspaper publishing license; Accepting the entrustment of a publishing unit to print an extended edition or supplement of a newspaper or periodical, it is also necessary to verify the documents approved by the competent publishing administrative department for publishing the extended edition or supplement.

article 18 when a printing enterprise accepts the entrustment to print internal information publications, it must verify the quasi-certificate issued by the publishing administrative department of the local people's government at or above the county level.

when a printing enterprise accepts the entrustment to print internal informational publications with religious contents, it must verify the approval documents of the religious affairs administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and the quasi-certification issued by the publishing administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.

the publishing administrative department shall, within 3 days from the date of receiving the application for printing internal informational publications or internal informational publications with religious contents, make a decision on whether to issue the approval certificate, and notify the applicant; If no decision is made within the time limit, it shall be deemed as consent to printing.

Article 19. When a printing enterprise accepts the entrustment to print publications outside China, it must obtain the approval of the publishing administrative department of the people's government of a province, autonomous region or municipality directly under the Central Government with the legal certificate of copyright. All printed overseas publications must be transported out of the country, and shall not be issued or distributed within the territory.

article 2 the entrusted printing unit must, in accordance with the relevant provisions of the state, publish the name and address of the publishing unit, the book number, serial number or edition number, the publication date or issue date, the real name and address of the enterprise that accepts the entrusted printing publication, and other relevant matters.

a printing enterprise shall, within 2 years from the date of completing the printing of publications, keep a sample of the publications entrusted for printing for future reference.

article 21 a printing enterprise shall not illegally print publications, sell, print without authorization or accept the entrustment of a third party to print the publications entrusted for printing, and shall not sell, lease, lend or transfer the paper forms and printing negatives of the publications entrusted for printing to other units or individuals in other forms.

article 22 a printing enterprise shall not subscribe for or sell publications, nor shall it print or sell publications in the name of others. Printing of printed matter for packaging and decoration

Article 23 An enterprise engaged in printing printed matter for packaging and decoration shall not print fake or forged registered trademark marks, and shall not print advertising materials that are likely to mislead consumers or printed matter used as product packaging and decoration.

Article 24 When a printing enterprise accepts the entrustment to print the logo of a registered trademark, it shall verify the copy of the Trademark Registration Certificate signed and sealed by the county-level administrative department for industry and commerce where the trademark registrant is located, and check the registered trademark pattern provided by the trustor; If a registered trademark is commissioned by a licensed user to print the logo of the registered trademark, the printing enterprise shall also verify the license contract for the use of the registered trademark. A printing enterprise shall keep a copy of the Trademark Registration Certificate, a registered trademark pattern and a copy of the registered trademark license contract signed by the administrative department for industry and commerce for verification and verification for 2 years for inspection.

if the state has other provisions on the printing of registered trademarks, printing enterprises should also abide by them.

article 25 when a printing enterprise accepts the entrusted printing of advertising propaganda materials and printed matter for product packaging and decoration, it shall verify the business license of the entrusted printing unit or the personal identity card; Accepting the entrustment of an advertising agent to print advertising promotional materials, it shall also verify the qualification certificate of advertising business.

article 26 when a printing enterprise accepts the entrustment of printing, packaging and decorating printed matter, it shall deliver all the finished products, semi-finished products, waste products, printing plates, paper forms, negatives and manuscripts of the printed matter to the entrusted printing unit or individual, and shall not keep them without authorization.

Article 27 If a printing enterprise accepts the entrustment to print printed materials for overseas packaging and decoration, it must file with the publishing administrative department of the local people's government of the province, autonomous region or municipality directly under the Central Government in advance; All printed packaging and decoration printed materials must be transported out of the country and may not be sold in China. Printing of other printed matter

Article 28 The printing of documents, materials, charts, etc. marked with classified information shall be handled in accordance with the relevant laws, regulations or rules of the state.

article 29 when printing notices, circulars, work permits for major events, passes and tickets circulating in the society, the entrusting printing unit must issue a certificate from the competent department, and go through the printing approval formalities with the public security department where the printing enterprise is located in accordance with the relevant provisions of the state, and print at the printing enterprise designated by the public security department. The printing enterprise designated by the public security department must verify the certificate of the competent department and the certificate of the public security department, and keep the copy of the certificate of the competent department and the copy of the certificate of the public security department for 2 years for inspection; And may not entrust others to print the above printed matter.

if a printing organ, organization, army, enterprise or institution uses valuable or priceless tickets internally, or prints special certificates such as letter of introduction, work permit, membership card, pass, degree certificate, academic certificate or other academic certificate with the name of the unit, the entrusting printing unit must issue a certificate of entrustment for printing. Printing enterprises must verify the certificate of entrusted printing.

A printing enterprise shall not keep samples or proofs for the printed articles mentioned in the preceding two paragraphs; If it is really necessary to keep samples and proofs for business reference, it shall obtain the consent of the entrusted printing unit, stamp the retained prints with "samples" and "proofs", and keep them properly, and shall not be lost.

Article 3 When a printing enterprise accepts the entrustment to print religious articles, it must verify the approval documents of the religious affairs administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and the quasi-certificates issued by the publishing administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government; The publishing administrative department of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall, within 1 days from the date of receiving the application for printing religious articles, make a decision on whether to issue the quasi-certificate, and notify the applicant; If no decision is made within the time limit, it shall be deemed as consent to printing.

article 31 individuals engaged in other printed matter printing business activities are not allowed to print documents, materials, charts, etc. marked with classified information, notices, work permits for major events, passes, tickets circulating in the society, valuable or priceless tickets used internally by organs, organizations, military units, enterprises and institutions, letters of introduction, work permits, membership cards, pass cards, degree certificates and academic qualifications with unit names.

article 32 whoever accepts the entrustment to print other printed materials abroad must file with the publishing administrative department of the local people's government of the province, autonomous region or municipality directly under the central government in advance; All other printed materials must be transported out of the country and may not be sold in China.

article 33 printing enterprises and individuals engaged in other printed matter printing business activities shall not illegally print other printed matter of others, shall not sell, print without authorization or accept other printed matter entrusted by a third party, and shall not sell, lease, lend or transfer paper forms and printing negatives of other printed matter entrusted to other units or individuals in other forms. Penalties

Article 34 Whoever, in violation of the provisions of these Regulations, establishes a printing enterprise or engages in printing business activities without authorization shall be banned by the public security department and the administrative department for industry and commerce according to their statutory functions and powers, and the printed matter, illegal income and special tools and equipment for illegal activities shall be confiscated. If the illegal business amount is more than 1, yuan, a fine of more than 5 times and less than 1 times the illegal business amount shall be imposed; If the illegal business amount is less than 1, yuan, a fine of 1, yuan to 5, yuan shall be imposed; If a crime is constituted, criminal responsibility shall be investigated according to law.

if a printing factory (institute) established within a unit fails to go through the formalities in accordance with the provisions of chapter ii of these regulations and engages in printing business activities, it shall be punished in accordance with the provisions of the preceding paragraph.

Article 35 If a printing operator violates the provisions of these Regulations and commits any of the following acts, the publishing administrative department of the local people's government at or above the county level shall order him to stop the illegal act, suspend business for rectification, confiscate printed matter and illegal income, and impose a fine of more than 5 times and less than 1 times the illegal business amount; If the illegal business amount is less than 1, yuan, a fine of 1, yuan to 5, yuan shall be imposed; If the circumstances are serious, the license shall be revoked by the original issuing authority; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) without obtaining the permission of the publishing administrative department, concurrently operating or changing to engage in the printing business activities of publications, packaging and decoration printed matter or other printed matter, or merging others without authorization.
