(1) The protection of registration is limited to registered trademarks.
If the trademark actually used by a person is inconsistent with the registered trademark, not only the exclusive right to use the trademark can not be effectively protected, but also it may bring four consequences: first, it constitutes an illegal act of changing the words, graphics or their combinations of registered trademarks; Second, there is a clear difference between a trademark that has been changed by itself and a trademark that has been approved for registration. At the same time, it is an illegal act to counterfeit a registered trademark. Third, if the changed trademark is similar to the registered trademark of others, it will constitute an act of infringing on the exclusive right of others to use the trademark; Fourth, the registered trademark has been revoked because it has not been used for three consecutive years.
(two) the protection of the exclusive right to use a registered trademark is limited to the goods approved for use.
If the goods actually used by the trademark registrant are inconsistent with the approved goods, it will not only fail to effectively protect the exclusive right to use the trademark, but also bring three consequences: First, using the registered trademark beyond the approved goods constitutes an illegal act of counterfeiting the registered trademark; Second, the registered trademark has been revoked because it has not been used on the approved goods for three consecutive years; Third, the use of a registered trademark beyond the approved scope of goods (except those similar to the approved goods) constitutes an act of infringing on the exclusive right of others to use trademarks.
