Yunnan Baiyao was created in 1902 by Qu Huanzhang, a famous Yunnan doctor. Qu exclusively mastered its formula and prepared it secretly.
In 1955, the Qu family dedicated the secret recipe of "Yunnan Baiyao" to the Yunnan Provincial Government. The Ministry of Health did state in its explanation of the “Regulations on State Secrets in Health Work and the Specific Scope of their Secret Levels” that “One of the top secret-level matters is the traditional Chinese medicine preparations listed as key national protections, which refers to proprietary Chinese medicines determined by the Ministry of Health. For example, the confidentiality period of Yunnan Baiyao is long-term.”
In August 1984, the State Administration of Medicine listed the formula and process of Yunnan Baiyao as national top secrets.
There are five main forms of intellectual property protection for traditional Chinese medicine in China, namely, national confidential prescriptions, patent protection, administrative protection, trademark protection and trade secret protection.
