Legal analysis: the application for trademark protection needs to be submitted to the Municipal Administration for Industry and Commerce. The function of trademark protection is to protect the trademark use rights of trademark registrants and trademark users according to law, inform others not to use the same or similar trademarks, and investigate the relevant responsibilities of illegal elements who infringe on the exclusive right to use registered trademarks of others.

Legal basis: Article 32 of the Regulations for the Implementation of the Trademark Law of People's Republic of China (PRC), if the exclusive right to use a registered trademark is transferred for reasons other than inheritance, the party accepting the exclusive right to use a registered trademark shall go through the formalities for the transfer of the exclusive right to use a registered trademark at the Trademark Office with relevant supporting documents or legal documents.

Where the exclusive right to use a registered trademark is transferred, the same or similar trademarks registered on the same or similar goods shall be transferred together; If they are not transferred together, the Trademark Office shall notify them to make corrections within a time limit; If it fails to make corrections within the time limit, it shall be deemed as giving up the application for transferring the registered trademark, and the Trademark Office shall notify the applicant in writing.

If the application for trademark transfer is approved, it shall be announced. The party accepting the assignment of the exclusive right to use a registered trademark shall enjoy the exclusive right to use the trademark from the date of announcement.
