The administrative department of agriculture of the provincial people's government shall be responsible for the acceptance and preliminary examination of the application for registration of geographical indications of agricultural products within their respective administrative areas. The expert review committee for the registration of geographical indications of agricultural products established by the Ministry of Agriculture is responsible for the expert review. Applying for geographical indication certification of agricultural products generally requires the following steps.
1. The applicant shall file an application for registration with the provincial administrative department of agriculture and submit the following materials in triplicate: an application for registration; The qualification certificate of the applicant; Quality appraisal report of geographical indication products of agricultural products; Technical specification for quality control; Documents with clear geographical scope and geographical distribution map of production; Physical samples or sample pictures of products; Other necessary explanations or evidential materials. The provincial administrative department of agriculture can determine the working mechanism and undertake the specific work of the registration and management of geographical indications of agricultural products.
2。 The provincial administrative department of agriculture shall, within 45 working days from the date of accepting the application for registration of geographical indications of agricultural products, complete the preliminary examination and on-site verification of the application materials in accordance with the regulations, and put forward the preliminary examination opinions. In line with the prescribed conditions, the provincial agricultural administrative department shall submit the application materials and preliminary examination opinions to the Agricultural Products Quality and Safety Center of the Ministry of Agriculture. If it does not meet the prescribed conditions, it shall notify the applicant in writing of the relevant opinions and suggestions within 10 working days from the date of putting forward the preliminary examination opinions. 3. After receiving the application materials and preliminary examination opinions, the Agricultural Products Quality and Safety Center of the Ministry of Agriculture shall complete the examination of the application materials within 20 working days, put forward the examination opinions and organize expert review. When necessary, the Agricultural Products Quality and Safety Center of the Ministry of Agriculture can organize the implementation of on-site nuclear _. The expert review shall be undertaken by the expert review committee for the registration of geographical indications of agricultural products, and shall be responsible for the review conclusion.
4. After passing the expert review, the Center for Agricultural Products Quality and Safety of the Ministry of Agriculture, on behalf of the Ministry of Agriculture, publicized the registered product name, registered applicant, registered geographical scope and corresponding technical specifications for quality control in public media such as Farmers Daily, China Agricultural Information Network and China Agricultural Products Quality and Safety Network. If the expert review is unqualified, the Ministry of Agriculture shall make a decision not to register, notify the applicant and the provincial agricultural administrative department in writing, and explain the reasons. 5。 Units and individuals who have objections to the contents of the publicity shall, within 30 days from the date of publicity, submit them in writing to the Agricultural Products Quality and Safety Center of the Ministry of Agriculture, and explain the specific contents and reasons of the objection. The Agricultural Products Quality and Safety Center of the Ministry of Agriculture will submit the objection to the local provincial agricultural administrative department for handling.
