Shanghai Municipal Administration for Market Regulation is a newly established unit under Shanghai Municipal Institutional Reform.
(1) Responsible for comprehensive market supervision and management. Implement laws, regulations, rules, policies and standards related to market supervision and management. Research and draft local laws and regulations on market supervision and management, formulate policies and plans, and organize their implementation. Implement the national quality strategy, food safety strategy and standardization strategy, maintain market order, and create a market environment of honesty, trustworthiness, and fair competition. Carry out investigation and research on relevant issues such as exploring the establishment of a new market supervision and management system in an open economy, and coordinate major issues in related fields.
(2) Responsible for the registration and licensing of market entities. Organize and guide the registration of market entities such as various enterprises, farmers' professional cooperatives, units engaged in business activities, individual industrial and commercial households, and permanent representative offices of foreign (regional) enterprises. Establish and improve the enterprise name approval system, and issue business licenses and related permits to relevant market entities. Develop implementation measures for food administrative licensing and supervise their implementation, and organize the implementation of food-related product production licensing work.
(3) Organize and guide the comprehensive law enforcement work of market supervision and management. Guide the construction of a comprehensive law enforcement team for market supervision and management in the district, promote the reform of the comprehensive law enforcement system in the field of market supervision and management in accordance with requirements, and implement unified comprehensive market supervision. Organize the investigation and handling of major illegal cases in the field of market supervision and management, and carry out supervision of major and important cases. Standardize the administrative law enforcement behavior of market supervision and management.
(4) Responsible for anti-monopoly law enforcement. Promote the implementation of competition policies and organize the implementation of a fair competition review system. According to the authorization of the state, it is responsible for anti-monopoly law enforcement work in accordance with the law such as monopoly agreements, abuse of market dominance and abuse of administrative power to eliminate or restrict competition. Assist and guide enterprises in responding to antitrust lawsuits abroad.
(5) Responsible for supervising and managing market order. Supervise and manage market transactions, online commodity transactions and related services in accordance with the law. Organize and guide the investigation and prosecution of illegal pricing and charging, unfair competition, illegal direct selling, pyramid schemes, illegal advertising, infringement of trademarks, patents and intellectual property rights, and the production and sale of counterfeit and shoddy products. Supervise and manage various consumer goods markets, production means markets, etc. in accordance with the law. Formulate systems and specific measures for contract supervision and management, organize and implement the supervision and management of contracts and auctions in accordance with the law, and manage the registration of chattel mortgages. Formulate advertising industry development plans and advertising industry professional standards, and supervise and manage advertising business activities. Organize the investigation and punishment of unlicensed production and operation and related unlicensed production and operation activities.
(6) Guide the Consumer Rights Protection Committee to carry out consumer rights protection work. Formulate rules and regulations related to the protection of consumers' legitimate rights and interests, and improve the consumer rights protection system. Responsible for the credit supervision of market entities. Establish an information disclosure and sharing mechanism for market entities, disclose and share relevant information in accordance with the law, and work with relevant departments to jointly promote the construction of a credit system for market entities and implement joint punishments.
(7) Responsible for macro quality management. Formulate and implement institutional measures for quality development, organize quality and technical research, strengthen the overall coordination of quality infrastructure collaborative services and applications, promote military-civilian integration in related fields, and establish and improve the quality development working system. Supervise enterprises to implement their main responsibilities for product quality. Promote brand development strategy and prepare and publish quality status analysis reports. Organize and implement the defective product recall system and supervise and manage product anti-counterfeiting work.
(8) Responsible for product quality and safety supervision and management. Manage product quality and safety risk monitoring, formulate key product quality monitoring catalogs, strengthen product quality and safety risk monitoring, and organize and implement product quality supervision and spot inspections. Establish and organize the implementation of a quality classification system and a quality and safety traceability system. Responsible for the management of industrial product production licenses. Manage and guide the quality supervision and inspection of fibers and fiber products.
(9) Responsible for the safety supervision and management of special equipment. Comprehensive management, organization and coordination of special equipment safety inspection and supervision work. Supervise and inspect the implementation of energy-saving standards for high-energy-consuming special equipment and boiler environmental protection standards. In accordance with the prescribed authority, organize the investigation and handling of special equipment accidents and conduct statistical analysis, and regularly announce the overall safety situation of special equipment to the public.
(10) Responsible for the comprehensive coordination of food safety supervision and management. Organize the formulation and implementation of food safety plans and major policies, and improve the food safety traceability system. Responsible for the construction of food safety emergency system, organizing and guiding emergency management and handling of food safety incidents.
Establish a unified release system for food safety information. Promote and improve the cross-regional and cross-department coordination and linkage mechanism for food safety.
(11) Responsible for food safety supervision and management. Establish a supervision and inspection system and a hidden danger investigation and management mechanism covering the entire process of food production, circulation, and consumption, and organize their implementation. Organize and carry out food safety supervision and sampling, risk monitoring, verification and disposal, risk warning, and risk communication. Organize and implement quality and safety supervision and management of the production and processing of special foods and food-related products.
(12) Responsible for the supervision and management of measurement work. Promote the national legal measurement units and the national measurement system, organize the establishment and management of the city's measurement benchmarks and public measurement standards, and be responsible for the organization, revision, approval and release of local measurement verification regulations and technical specifications. Manage measuring instruments and value transfer and comparison work, standardize and supervise commodity volume and market measurement behavior.
(13) Responsible for managing standardization work. Organize the preparation and implementation of standardization development strategies, government standardization guidance policies and instructions, and organize and promote "Shanghai Standards" work. Organize and promote the implementation of national standards, industry standards and local standards, promote international standardization activities and adopt international standards and advanced foreign standards. Responsible for the organization, revision, approval and release of local standards.
(14) Responsible for the supervision and management of inspection and testing work. Standardize the inspection and testing market and promote the reform and development of the inspection and testing industry. Improve the inspection and testing system, and enhance the level and internationalization level of market supervision and management technical institutions.
(15) Responsible for the supervision, management and comprehensive coordination of certification and accreditation work. Organize and implement the national unified certification, accreditation and conformity assessment supervision and management system, encourage and guide various organizations to carry out management systems and voluntary product certification, be responsible for the registration management of certification institutions, and supervise and manage certification activities.
(16) Responsible for market supervision and management technology and information construction. Promote the construction of a standardized public information service system and promote relevant news releases and government affairs disclosure work. Carry out international exchanges and cooperation, and be responsible for relevant notification and consultation work on the World Trade Organization Agreement on Technical Barriers to Trade.
(17) Responsible for the supervision and management of energy measurement of key energy-consuming units, promote energy measurement work, and promote green development. Organize the formulation (revision) of local standards for energy conservation and environmental protection, and organize the implementation of the energy efficiency labeling management system.
(18) Manage the Shanghai Municipal Food and Drug Administration and the Shanghai Municipal Intellectual Property Office.
(19) Complete other tasks assigned by the municipal party committee and municipal government.
