1, trademark search
Before trademark registration, the applicant needs to search the name of the applied trademark and check whether any identical or similar trademark has applied for registration on the same or similar goods or services.
Step 2 submit an application
After searching, the trademark does not exist if it is similar to or the same as the trademark file of the earlier application. Applicants can apply for registration. According to the international classification of goods and services registered by trademarks, goods and services are divided into 45 categories.
3. Trademark review
After receiving an application for trademark registration, the Trademark Office of Thailand will conduct formal examination and substantive examination of the trademark application to determine whether the application documents submitted are complete, whether the applied trademark is distinctive and whether it violates the relevant prohibitive provisions of the Trademark Law. Trademark documents that fail to meet the requirements after examination will be rejected. If the applicant is not satisfied with the ruling made by the Trademark Office, he may request the Trademark Board of Thailand to review it. The examined trademark documents will be awarded the application date and application number.
4. Trademark statements and objections
The trademark documents that have passed the examination enter the trademark announcement period, and will be published in the official trademark announcement of Thailand after the examiner considers the trademark application acceptable. 90 days from the date of announcement is the objection period. During the objection period, anyone can raise an objection to the trademark application, and finally the examiner will make a ruling on the objection result.
5. Trademark registration is completed
During the objection period, if no one objects to the trademark application, the trademark will be approved for registration. The period of validity of trademark registration is 10 year, counting from the date of application. The trademark registrant shall go through the renewal formalities within 3 months before the expiration of the trademark, and the renewal period is 10 year.
