Geographical indications can be registered with the Trademark Office as service marks and collective marks, but they cannot be registered as commodity trademarks. A geographical indication applied for registration as a collective trademark or certification mark can be the name of the region indicated by the geographical indication, or other visible signs that can indicate that a certain product originates from the region. Article 16 of the "Trademark Law of the People's Republic of China" If a trademark contains a geographical indication of a product, but the product does not originate from the area indicated by the mark, misleading the public, Registration is not allowed and use is prohibited; however, registration that has been obtained in good faith will continue to be valid. The geographical indications mentioned in the preceding paragraph refer to signs indicating that a certain commodity originates from a certain region and that the specific quality, reputation or other characteristics of the commodity are mainly determined by the natural factors or humanistic factors of the region.
