Chapter IV Legal Liability:

Article 36 Where an applicant provides false information or samples or obtains a license certificate by other deceptive means, the license issuing organ shall revoke the relevant license certificate and impose a fine of not less than 50,000 yuan but not more than 65,438+10,000 yuan. The applicant shall not apply for administrative license again for the same matter within three years. Whoever obtains the license certificate by deception and causes losses to others shall be liable for compensation according to law.

Article 38 Where feed or feed additive is produced without a production license, the feed administrative department of the local people's government at or above the county level shall order it to stop production, confiscate the illegally obtained and illegally produced products, feed raw materials, single feed, feed additive, pharmaceutical feed additive, additive premixed feed and raw materials used for illegally producing feed additive, and the value of illegally produced products is less than 654.38 million yuan. A fine of 1 10,000 yuan but not more than 50,000 yuan, and a fine of 5 times or more 1 10,000 yuan or more; If the circumstances are serious, the production equipment shall be confiscated, and the main person in charge of the production enterprise and the directly responsible person in charge shall not engage in the production and business activities of feed and feed additives for 10 years. If a production license has been obtained, but the production license and conditions stipulated in Article 14 of these regulations are no longer met, the feed management department of the local people's government at or above the county level shall order it to stop production, make corrections within a time limit and impose a fine of 6,543,800 yuan to 50,000 yuan; If no correction is made within the time limit, the production license shall be revoked by the issuing authority. If a production license has been obtained, but the product approval number has not been obtained, the feed management department of the local people's government at or above the county level shall order it to stop production, confiscate the illegal income, illegally produced products, feed raw materials, single feed, feed additives, pharmaceutical feed additives and raw materials used for illegally producing feed additives, re-submit the product approval number within a time limit, and impose a fine of not less than 3 times the value of illegally produced products/kloc-0; If the circumstances are serious, the production license shall be revoked by the issuing authority.

Article 39 Where a feed or feed additive production enterprise commits any of the following acts, the feed management department of the local people's government at or above the county level shall order it to make corrections, confiscate the illegally obtained and illegally produced products, feed raw materials, single feed, feed additives, pharmaceutical feed additives, additive premixed feed and raw materials used for illegally producing feed additives, and the value of illegally produced products is less than 654.38 million yuan. A fine of 1 10,000 yuan but not more than 50,000 yuan, and a fine of 5 times or more 1 10,000 yuan or more; If the circumstances are serious, the relevant license documents shall be revoked by the issuing authority, and the main person in charge of the production enterprise and the directly responsible person in charge shall not engage in the production and business activities of feed and feed additives for 10 years; If it constitutes a crime, criminal responsibility shall be investigated according to law: 1. The use of feed raw materials, single feed, feed additives, pharmaceutical feed additives and additive premix to produce feed does not meet the restrictive provisions of the administrative department of agriculture of the State Council; Two, the use of the State Council agricultural administrative departments announced the catalogue of feed raw materials, feed additives and drug feed additives directory outside the raw materials to produce feed; Three, without obtaining the certificate of new feed, new feed additives to produce new feed, new feed additives or banned feed, feed additives.

Fortieth feed, feed additives production enterprises have one of the following acts, the feed management department of the local people's government at or above the county level shall order it to make corrections, and impose a fine of 1000 yuan to 20000 yuan; Refuses to correct, confiscate the illegal income, illegally produced products and feed raw materials, single feed, feed additives, pharmaceutical feed additives, additive premixed feed and raw materials used for illegally producing feed additives, and impose a fine of not less than 50,000 yuan but not more than 6,543,800 yuan; If the circumstances are serious, it shall be ordered to stop production, and the relevant license documents may be revoked or revoked by the issuing authority: 1. Failing to inspect or test the purchased feed raw materials, single feed, feed additives, pharmaceutical feed additives, additive premixed feed and raw materials used for the production of feed additives in accordance with these regulations and the relevant standards of the administrative department of agriculture of the State Council; Two, feed, feed additives in the production process does not meet the requirements of the State Council agricultural administrative departments to develop feed, feed additives quality and safety management norms and feed additives safety use norms; Three, the production of feed, feed additives without product quality inspection.

Forty-first feed and intellectual materials are transported to Liu's production enterprise, and the political examination, production and sales filing system or product publicity system outside the province are not implemented according to the provisions of this article. The feed management department of the local people's government at or above the county level shall order it to make corrections and impose a fine of 1000 yuan to 20000 yuan; Refuses to correct, confiscate the illegal income, illegally produced products, feed raw materials, single feed, feed additives, pharmaceutical feed additives, additive premixed feed and raw materials used for illegally producing feed additives, and impose a fine of not less than 20,000 yuan but not more than 50,000 yuan, and the relevant license documents may be revoked by the issuing authority. Feed and feed additives sold by feed and feed additive production enterprises are not accompanied by product quality inspection certificates or the packaging and labels do not meet the requirements, and the feed management department of the local people's government at or above the county level shall order it to make corrections; If the circumstances are serious, the illegal gains and illegally sold products shall be confiscated, and a fine of less than 30% of the value of illegally sold products may be imposed.

Article 46 Where an operator of a feed or feed additive enterprise commits any of the following acts, the feed management department of the local people's government at or above the county level shall order him to stop production and operation, confiscate the illegal income and products illegally produced and operated, and impose a fine of more than 2 times and less than 5 times the value of the products illegally produced and operated. If it constitutes a crime, criminal responsibility shall be investigated according to law: 1. In the process of production and operation, passing off non-feed or non-feed additives as feed or feed additives, or passing off the feed or feed additives as other kinds of feed or feed additives; Two, the production and operation of feed and feed additives without product quality standards or do not meet the product quality standards; Three, the production and operation of feed, feed additives and label content does not match. Feed and feed additive production enterprises have the acts listed in the preceding paragraph, and if the circumstances are serious, the relevant license documents shall be revoked or revoked by the issuing authority; Operators of feed and feed additives who commit the acts listed in the preceding paragraph, if the circumstances are serious, shall notify the administrative department for industry and commerce, and the administrative department for industry and commerce shall revoke their business licenses.
