How to apply for trademark transfer

2. Prepare relevant materials

1. Trademark agency power of attorney signed or stamped by the trademark transferee.

2. Trademark transfer application signed or sealed by the trademark transferor and transferee.

3. A copy of the trademark transferee’s business license/ID card and individual industrial and commercial household registration certificate.

4. A copy of the trademark transferor’s business license/ID card.

5. A copy of the trademark transfer agreement signed or sealed by the transferor and the transferee.

3. Trademark transfer process

1. The buyer signs a transfer agreement with the seller and pays the purchase deposit. The buyer needs to provide a copy of his ID card or business license.

2. The seller (trademark holder) handles trademark notarization and signs related documents, which takes about 3-7 working days. At this time, the buyer can directly use the trademark. If you need to use the trademark urgently, it is recommended to purchase the trademark directly.

3. The trademark agency will hand over the trademark registration certificate, notarial certificate and other documents to the buyer, and wait for the Trademark Office to accept it. The trademark certificate will be obtained in 3-5 months.

Legal basis:

Article 42 of the "Trademark Law of the People's Republic of China" When a registered trademark is transferred, the transferor and the transferee shall sign a transfer agreement and ***Apply to the Trademark Office at the same time. The transferee shall ensure the quality of the goods using the registered trademark.

When transferring a registered trademark, the trademark registrant shall transfer all similar trademarks registered on the same goods, or identical or similar trademarks registered on similar goods.

For transfers that are likely to cause confusion or have other adverse effects, the Trademark Office will not approve the transfer and will notify the applicant in writing and explain the reasons.

After the transfer of a registered trademark is approved, it will be announced. The assignee shall enjoy the exclusive right to use the trademark from the date of announcement.
