1. Trademark inquiry

Before applying for trademark registration, the applicant may consider checking the applied trademarks to see whether the same or similar trademarks have been applied for or registered on the same or similar goods or services.

2. application for registration

if the query results show that no other people's identical or similar trademarks have existed on similar goods or services before, the applicant can apply. According to the International Classification of Goods and Services for Trademark Registration, goods and services are divided into 45 categories.

3. Examination Procedures

Within three to four months after receiving the application for trademark registration, the Intellectual Property Office of Thailand will conduct formal examination and substantive examination on the trademark application to determine whether the application documents submitted are complete, whether the trademark applied for is distinctive, whether it violates the relevant prohibition provisions of the Trademark Law and whether it is the same as or similar to the trademark previously applied for or registered by others on the same or similar goods. If the application does not meet the registration requirements after examination, the trademark application will be rejected. If the applicant is not satisfied with the ruling made by the Intellectual Property Office, he may request a review to the Trademark Board of Thailand.

4. announcements and objections

after examination, the examiner thinks that the trademark application is acceptable, and then he will publish an announcement in the official trademark announcement of Thailand. 9 days from the date of announcement is the objection period. During the objection period, anyone can object to the trademark application. The applicant can reply to the objection. The examiner will rule on the result of the objection.

5. Approved registration

If no objection is raised to the trademark application within 9 days after the announcement, the trademark will be approved for registration. Trademark registration is valid for 1 years, counting from the date of application. The trademark registrant shall go through the renewal formalities within 9 days before the expiration of the trademark. The renewal is valid for 1 years. After the registration of a trademark, the trademark registrant shall use the registered trademark in Thai business. If, after the registration of a trademark, the trademark registrant has not used the registered trademark in Thailand for three consecutive years, others may request the Intellectual Property Office of Thailand to cancel the registered trademark on the grounds that the registrant has not actually used the registered trademark.
