Paragraph 3 of Article 39 of the Regulations on the Implementation of Trademarks stipulates: "In addition to the evidence that the trademark registrant himself uses his registered trademark, of course, the evidence that the trademark registrant allows others to use the registered trademark shall also be regarded as the evidence of using the registered trademark."
The licensed use of trademark registration refers to the legal act that the owner of a registered trademark authorizes others to use his registered trademark within the prescribed scope and time limit and get paid through a licensing contract.
The Trademark Law stipulates that anyone who licenses the use of another person's registered trademark, whether it is an exclusive license or a general license, must indicate the name of the licensee and the place of origin of the product on the goods using the registered trademark.
If the licensee fails to use the trademark in accordance with the above-mentioned laws, there will be the risk of illegal use of the trademark, and in the process of providing evidence of trademark use, it may not be able to effectively provide evidence of the legal use of the subject matter.
Accordingly, if there is no record, as long as the trademark registrant can systematically list the above-mentioned proof materials for actual use in the process of proof, the Trademark Office will determine that the trademark is indeed legal and actually used. The registrant's exclusive right to use a trademark will be protected by law.
