The conditions for a trademark to be registered are non-conflict: it must not infringe the rights and interests legally enjoyed by others before the application date. Prior legal rights refer to the rights that have been legally acquired before the date of application and the legitimate rights and interests that should be protected by law, including name rights, portrait rights, copyrights, title rights and the unique names and decorations of well-known products. If a registered trademark infringes upon the legitimate prior rights of others, it is an improper registration. Within 5 years from the trademark registration, the prior rights owner or interested party may request the Trademark Review and Adjudication Board to declare the registered trademark invalid. For cases registered in bad faith, the owner of a well-known trademark is not subject to the 5-year time limit.
