There are various types of malicious pre-registration of other people’s trademarks, hoarding of trademarks for sale, and imitation of famous brands. This not only harms the legitimate rights and interests of prior rights holders, but also disrupts the fair competition market environment, causing great harm.
To this end, the Trademark Office of the State Administration for Industry and Commerce has already carried out a lot of work. It is understood that this year, the Trademark Office has held discussions with famous writers such as Zheng Yuanjie and Liang Fengyi to learn about trademark rights protection issues such as "Pipilu" and "Wesley". In August, it also held a seminar on the protection of prior rights and interests such as the names of well-known works and character names. . In addition, in recent years, the Trademark Office has held various seminars with competent authorities in Europe, the United States and other countries to discuss how to curb malicious registration practices.
Cui Shoudong, deputy director of the Trademark Office of the State Administration for Industry and Commerce, revealed that the Trademark Office currently plans to take four measures:
First, move the gateway forward, and adopt early review, Measures such as centralized review of combined cases and strict application of laws will be adopted to strictly and expeditiously try large-scale malicious trademark squatting cases;
The second is to study and determine the list of key trademark protections and determine the corresponding protection scope and legal application plan;
The third is to carry out special rectification actions and make targeted breakthroughs in six prominent forms of malicious registration;
The fourth is to establish a database of lists of malicious registration suspects.
