Legal Basis

Article 425 of the "People's Republic of China and Civil Code"

For the performance of guaranteed debts, the debtor or a third party If a person pledges his movables to the creditor for possession, and the debtor fails to perform the due debt or the circumstances agreed by the parties to realize the pledge occur, the creditor shall have the right to receive priority payment for the movables.

The debtor or third party specified in the preceding paragraph shall be the pledger, the creditor shall be the pledgee, and the movable property delivered shall be the pledged property.

Article 427

To establish a pledge, the parties shall enter into a pledge contract in writing.

Article 429

The right of pledge is established when the pledger delivers the pledged property.
