Paragraph 5 of Article 14 of the Trademark Law clearly stipulates that "producers and business operators shall not use the words' well-known trademarks' in commodities, commodity packages or containers, or in advertising, exhibitions and other commercial activities".
a well-known trademark refers to a trademark that is well known to the relevant public in China. It is pointed out in the Provisions on the Recognition and Protection of Well-known Trademarks that the relevant public includes consumers related to the use of certain goods or services marked by trademarks, other operators who produce the above-mentioned goods or provide services, and sellers and related personnel involved in distribution channels.
