What if the trademark registration certificate is missing?

Sometimes we get a phone call from a customer saying that the trademark has been registered for some time, and when we need to use it later, we find that the trademark registration certificate is missing. What should we do if the trademark registration certificate is missing? Is it possible to correct the same thing, and what information and process are needed? On this issue, the trademark transfer network will introduce you to the specific operation methods.

(1) If the Trademark Registration Certificate is lost, if the application for a replacement certificate is complete and in compliance with the regulations, after examination and approval, the Trademark Office will publish a statement of loss in the Trademark Announcement and issue a Notice of Obtaining a Trademark Registration Certificate; If the Trademark Registration Certificate is damaged, the applicant shall return the Trademark Registration Certificate to the Trademark Office when submitting the application for replacement. If the application for replacement certificate is complete and meets the requirements, the Trademark Office will issue the Notice of Receiving the Trademark Registration Certificate after examination and approval.

(2) if you go directly to the trademark registration hall, after receiving the Notice of Obtaining a Trademark Registration Certificate from the Trademark Office, the applicant shall promptly go to the trademark registration hall to obtain the Trademark Registration Certificate according to the notification requirements. If you have not received the Notice of Obtaining a Trademark Registration Certificate for various reasons, you should submit the following documents when you receive the Trademark Registration Certificate in the Trademark Registration Hall:

1. A copy of the subject qualification certificate (copy of business license, ID card, etc.) confirmed by the seal or signature of the trademark registrant;

2. Letter of introduction from the licensing unit;

3. ID card and photocopy of the witness (the original will be returned after comparison);

If the official seal of the original trademark registrant has become invalid, the application can be stamped with the official seal of the changed trademark registrant, but the corresponding certificate issued by the administrative department for industry and commerce should be submitted.

3. If the replacement certificate is handled together with the transfer, if the application for replacement certificate is made in the name of the transferor, the reissued Trademark Registration Certificate is in the name of the transferor; If the application for a replacement certificate is made in the name of the assignee, the reissued Trademark Registration Certificate is in the name of the assignee.
